--- 1lø ~ ~ "-. --- LEASE OF AIRPORT PROPERTY/BUILDINGS THE STATE OF TEXAS COUNTY OF HAYS This Lease Agreement ("Lease") is made and entered into by and between the City of San I Marcos, ( "Lessor") and San Marcos Civil Air Patrol Squadron ("Lessee"). The Lessor is the owner of the San Marcos Municipal Airport, situated in Caldwell County, Texas, hereinafter referenced to as "Airport," by virtue of deeds from the United States of America. All covenants, terms and conditions of this Lease are subject to approval by the Federal Aviation Administration. In consideration of the obligation of Lessee to pay rent provided and in consideration of the other terms, covenants and conditions, Lessor demises and leases to Lessee, and Lessee takes from Lessor the buildings located on the San Marcos Airport, at 1915 Airport Drive (containing 3,026 square feet) and 1945 Airport Drive (containing 3,071 square feet),(the "Leased Premises"), commencing on Aug ust 1, 1997, all upon the following terms and conditions: ARTICLE 1. Acceptance of Existing Premises 1.1 Lessee acknowledges that it has, prior to the execution of this Lease, inspected the Leased Premises, and that Lessee is accepting the Leased Premises in its "as is" condition. By occupying the Leased Premises, Lessee shall be deemed to have apcepted the same and to have acknowledged that the same comply fully with Lessor's covenants. 1.2. Lessee acknowledges that it has read and will comply with the Minimum Standards for Fixed Base Operators and Airport Tenants ("Minimum Standards") as published by Lessor which applies to Lessee's business endeavors. ARTICLE 2. Term/Rent 2.1 Rental shall accrue from the commencement date of this Lease, and shall be payable at the place designated for the delivery of notices to Lessor at the time of payment. 2.2 Lessee shall pay to Lessor a fixed rental in the sum of $1.00 per year for the overall Leased Premises described above. Under no circumstances will the Lessor be responsible for the cost of any improvements made by the Lessee that exceed the fixed rental fees due and payable during the terms of this Lease. 2.3 As further consideration and rental for the Leased Premises, Lessee agrees to pay to Lessor a monthly fee for the use of tie-down facilities or any other facilities for aircraft, motor vehicles or any other equipment or items, under the custody and control of tlie Lessee or any employees, agents or customers of the Lessee which are outside of the Leased Premises. The excess space or area will be charged at the then established standard rental or use fee as prescribed by the Lessor. 1
