<br /> --- 1lø <br />~ ~ <br />"-. --- <br /> LEASE OF AIRPORT PROPERTY/BUILDINGS <br /> THE STATE OF TEXAS <br /> COUNTY OF HAYS <br /> This Lease Agreement ("Lease") is made and entered into by and between the City of San <br />I Marcos, ( "Lessor") and San Marcos Civil Air Patrol Squadron ("Lessee"). <br /> The Lessor is the owner of the San Marcos Municipal Airport, situated in Caldwell County, <br /> Texas, hereinafter referenced to as "Airport," by virtue of deeds from the United States of America. <br /> All covenants, terms and conditions of this Lease are subject to approval by the Federal <br /> Aviation Administration. <br /> In consideration of the obligation of Lessee to pay rent provided and in consideration of the <br /> other terms, covenants and conditions, Lessor demises and leases to Lessee, and Lessee takes <br /> from Lessor the buildings located on the San Marcos Airport, at 1915 Airport Drive (containing <br /> 3,026 square feet) and 1945 Airport Drive (containing 3,071 square feet),(the "Leased Premises"), <br /> commencing on Aug ust 1, 1997, all upon the following terms and conditions: <br /> ARTICLE 1. <br /> Acceptance of Existing Premises <br /> 1.1 Lessee acknowledges that it has, prior to the execution of this Lease, inspected the Leased <br /> Premises, and that Lessee is accepting the Leased Premises in its "as is" condition. By <br /> occupying the Leased Premises, Lessee shall be deemed to have apcepted the same and <br /> to have acknowledged that the same comply fully with Lessor's covenants. <br /> 1.2. Lessee acknowledges that it has read and will comply with the Minimum Standards for Fixed <br /> Base Operators and Airport Tenants ("Minimum Standards") as published by Lessor which <br /> applies to Lessee's business endeavors. <br /> ARTICLE 2. <br /> Term/Rent <br /> 2.1 Rental shall accrue from the commencement date of this Lease, and shall be payable at the <br /> place designated for the delivery of notices to Lessor at the time of payment. <br /> 2.2 Lessee shall pay to Lessor a fixed rental in the sum of $1.00 per year for the overall Leased <br /> Premises described above. Under no circumstances will the Lessor be responsible for the <br /> cost of any improvements made by the Lessee that exceed the fixed rental fees due and <br /> payable during the terms of this Lease. <br /> 2.3 As further consideration and rental for the Leased Premises, Lessee agrees to pay to Lessor <br /> a monthly fee for the use of tie-down facilities or any other facilities for aircraft, motor <br /> vehicles or any other equipment or items, under the custody and control of tlie Lessee or <br /> any employees, agents or customers of the Lessee which are outside of the Leased <br /> Premises. The excess space or area will be charged at the then established standard rental <br /> or use fee as prescribed by the Lessor. <br /> 1 <br />
