<br /> . . <br />, 7 {,/I- <br />2.4 Lessor agrees that all airport revenue derived from Lessee and any other use of the property <br /> shall be allocated toward the maintenance of the Airport and improvements; provided, <br /> however, that this requirement shall not be considered mandatory upon Lessor unless it is <br /> so required by existing indenture or agreement with the Federal Govemment or any amenqed <br /> or substitute indentures and agreements entered into with the Federal Government. <br />2.5 Should Lessee fail to pay when due any rent or any other sum payable to the Lessor under <br />--- the tenns of this Lease, then interest at the maximum legal rate then payable by Lessee in <br /> the State of Texas shall accrue from and after the date on which any sum shall become due <br /> and payable, and interest shall be paid by Lessee to Lessor at the time of payment of the <br /> sum upon which the interest shall have accrued. <br />2.6 The term of this Lease shall commence on June 24, 1997 and shall extend for a period of <br /> 5 years with the Lessee having the option to renew for a subsequent 5 year period provided <br /> Lessee is not in default under the terms of this Lease at the time of renewal. The renewal <br /> term shall commence on the day following the expiration of this original term if Lessee <br /> provides Lessor with written notice of its intent no more than 60 days, nor less than 30 days <br /> prior to the date of the expiration of the first 10 year term. Renewal shall be on the same <br /> terms and conditions as stated in this Lease, unless altered or amended at the time of <br /> renewal as provided for in Section 17.1 B of this Lease, except that all rental charges <br /> provided shall be renegotiated prior to renewal. <br /> ARTICLE 3. <br /> Use and Care of Premises <br /> . <br />3.1 The uses of the premises by Lessee shall be restricted to those connected with aviation <br /> purposes or aviation-related purposes, except for uses allowed by written agreement. <br /> Specifically, the Leased Premises shall be used and occupied only for the purpose of <br /> operating an active unit of the Civil Air Patrol, and for no other purposes without the prior <br /> written consent of Lessor. Lessee shall not at any time leave the Leased Premises vacant, <br /> but shall in good faith continuously throughout the term of this Lease conduct and carry on <br /> in the Leased Premises the type of activity for which the Leased Premises are leased, and <br /> shall keep the Leased Premises open to the public for business during normal business <br /> hours. <br />3.2 Lessee shall not, without Lessor's prior written consent, keep anything within the Leased <br /> Premises or use the Leased Premises for any purpose which increases the insurance <br /> premium cost or invalidates any insurance policy carried on the Leased Premises. All <br /> property kept, stored or maintained within the Leased Premises by Lessee shall be at <br /> Lessee's sole risk. <br />3.3 Lessee shall not, without Lessor's prior written consent, conduct within the Leased Premises <br /> any objectionable activity, nor permit any objectionable or unpleasant odors to emanate from <br /> the premises; nor take any other action which would disturb or endanger the Rublic. <br />3.4 Lessee shall take good care of the Leased Premises and keep it free from waste at all times. <br /> Lessee shall keep the Leased Premises, including ramps, signs, sidewalks, serviceways, <br /> and loading areas adjacent to the premises neat, clean, and free from dirt or rubbish at all <br /> times, and shall store all trash and garbage within the Leased Premises, arranging for the <br /> regular pick-up of such garbage at Lessee's expense. <br /> 2 <br />
