Texas 78666, hereinafter called !fLessee; II \vi tnesseth <br /> that: <br /> Nm.¡ THEREFORE 1 in consideration of the rents to be paid <br /> and the mutual covenants to be performed, the parties agree <br /> as follows: <br /> 1. DESCRIPTION OF LEASED PREMISES: Lessor does <br /> lease, demise and let unto Lessee that real property and <br /> improvements, being 450 square feet, more or less, situated <br /> in San Marcos, Hays County, Texas, with the address of <br /> Suite 101, 120 West Hopkins street. <br /> "1 TERM: The Lessor agrees to lease the premises to <br /> .:... the Lessee for an original term beginning on the ~ day of <br /> August 1 1997, and terminating on the last day of <br /> December, 1997. <br /> ? RENEWALS: Lessee shall, by giving written notice <br /> ..;. to the Lessor on or before the thirtieth (30th) day prior to <br /> the expiration of this lease, have the option to renew this <br /> lease for a period of one (1) year at a rental rate to be <br /> agreed upon by the parties and under the same terms and <br /> conditions as stated in this agreement. <br /> 4. HOLDING OVER: If the Lessee remains in possession <br /> of the leased premises after the expiration of this lease, <br /> and without the execution of a new lease, the Lessee shall <br /> be deemed to be occupying the leased premises as a tenant <br /> from month-to-month, subject to all conditions, provisions, <br /> and obligations of this lease except that monthly rental <br /> shall be increased to FOUR HUNDRED FIFTY and 00/100 Dollars <br /> ($450.00) . <br /> 5 RENTAL: Lessee shall pay to Lessor at the address <br /> above, rent at the rate of ONE and 00/100 ($1.00) per month <br /> for each month, payable up to 12 months in advance, during <br /> the term of this lease. The rent for each month is due on <br /> the first day of that month unless paid in advance. <br /> 6. USE OF THE PREMISES: The leased premises shall be <br /> used as office space for the San Marcos Police Department <br /> (SMPD) by Lessee.
