Regular Meeting June 23, 2003 Page 4 Mayor Habingreither opened the public hearing and asked if anyone wished to speak. 1) Lucy Badillo stated she is the owner of 602 Valley Street and wants her property rezoned. No one else wished to speak, so Mayor Habingreither closed the public hearing. Ms. Narvaiz moved for adoption of the Zoning Ordinance and Mr. Mihalkanin seconded the motion, which passed unanimously. Mayor Habingreither introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 2, ARTICLE 5 OF THE CITY CODE TO REVISE AND UPDATE THE CITY ETHICS ORDINANCE; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Ms. Narvaiz moved for approval of Ordinance and Mr. Mihalkanin seconded the motion. Mr. Taylor inquired why the proposed changes were before the Council. Mr. Mark Taylor stated the Ethics Review Commission began a study of the ethics ordinance and considered some possible revisions. They recommended the restriction to private interaction with other boards. This would prohibit a Board or Commission member from privately lobbying other members of the Board or Commission on behalf of private interests. Mr. Mark Taylor also stated the Ethics Review Commission added the definition of ~domestic partner". Ms. Narvaiz stated she feels people should be able to face their accuser. Mr. Thomaides stated he feels this proposed Ordinance is trying to eliminate conflicts. Mayor Habingreither moved to table this item until September, 2003 and Ms. Narvaiz seconded the motion, which passed unanimously. Mayor Pro-Tem Montoya introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE RELEASE OF AN ELECTRIC UTILITY EASEMENT WITHIN TWO TRACTS OF REAL PROPERTY OWNED BY AMERICAN CAMPUS (SWT II), LTD. IN THE 200 BLOCK OF LINDSEY STREET; AUTHORIZING THE CITY MANAGER TO EXECUTE A RELEASE OF EASEMENT; AND INCLUDING PROCEDURAL PROVISIONS. Mr. Taylor moved for approval of the Ordinance and Ms. Narvaiz seconded the motion. On roll call the following voted was recorded: AYE: Narvaiz, Thomaides, Montoya, Taylor and Diaz. NAY: None.
