16~. <br />Regular Meeting June 23, 2003 Page 4 <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished <br />to speak. 1) Lucy Badillo stated she is the owner of 602 Valley Street <br />and wants her property rezoned. No one else wished to speak, so Mayor <br />Habingreither closed the public hearing. Ms. Narvaiz moved for adoption <br />of the Zoning Ordinance and Mr. Mihalkanin seconded the motion, which <br />passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 2, ARTICLE 5 OF THE CITY CODE TO REVISE AND UPDATE <br />THE CITY ETHICS ORDINANCE; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />Ms. Narvaiz moved for approval of Ordinance and Mr. Mihalkanin seconded <br />the motion. Mr. Taylor inquired why the proposed changes were before the <br />Council. Mr. Mark Taylor stated the Ethics Review Commission began a <br />study of the ethics ordinance and considered some possible revisions. <br />They recommended the restriction to private interaction with other boards. <br />This would prohibit a Board or Commission member from privately lobbying <br />other members of the Board or Commission on behalf of private interests. <br />Mr. Mark Taylor also stated the Ethics Review Commission added the <br />definition of ~domestic partner". Ms. Narvaiz stated she feels people <br />should be able to face their accuser. Mr. Thomaides stated he feels this <br />proposed Ordinance is trying to eliminate conflicts. Mayor Habingreither <br />moved to table this item until September, 2003 and Ms. Narvaiz seconded <br />the motion, which passed unanimously. <br /> <br />Mayor Pro-Tem Montoya introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE RELEASE OF AN ELECTRIC UTILITY EASEMENT WITHIN TWO <br />TRACTS OF REAL PROPERTY OWNED BY AMERICAN CAMPUS (SWT II), LTD. IN <br />THE 200 BLOCK OF LINDSEY STREET; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE A RELEASE OF EASEMENT; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Mr. Taylor moved for approval of the Ordinance and Ms. Narvaiz seconded <br />the motion.
