169. <br />Regular Meeting June 23, 2003 Page 6 <br /> <br />vacant now and an additional eleven potential locations within the City. <br />She stated the Council needs to extend the cap and replace program to IH35 <br />in order to provide incentive for companies to remove signs in sensitive <br />areas. Mr. Taylor inquired whether the ETJ between San Marcos and New <br />Braunfels can legally be included in the City cap and replace program. <br />Mr. Mark Taylor stated the City currently has an agreement with New <br />Braunfels, which defines the ETJ border as Watson Lane. Mr. Diaz supports <br />the Ordinance including extending a cap and replace program to IH35. Ms. <br />Narvaiz stated she in not in favor of a cap and replace program including <br />IH35. Mr. Mihalkanin stated he agrees with Mr. Diaz on extending the cap <br />and replace program to IH35. Mr. Montoya stated he agrees with Ms. <br />Narvaiz in regard to not including IH35 in the cap and replace program. <br />Mr. Taylor asked the Planning Department to provide a confirmation of the <br />actual number of vacant locations. Mr. Thomaides stated he would like the <br />Planning Department to provide a detailed explanation regarding the <br />consequences of including and excluding the cap and replace program on <br />IH35. Mr. Thomaides moved to amend Section 106.074(e) (2)d. to change <br />Comanche Street to Thorpe Lane and Mr. Mihalkanin seconded the motion. <br />Mr. Thomaides stated he feels this amendment will protect greenspace and <br />the entrance into the City. The Council then voted unanimously for the <br />amendment. Mr. Thomaides also stated there are double stack billboards on <br />Wonder World Drive. He inquired what effect this will have on the Wonder <br />World extension. John Gannon stated he is the owner of the double stacked <br />billboards and TxDOT has contacted him. He informed the Council he would <br />be happy to move his billboards to IH35. Mr. Mihalkanin moved to amend <br />Section 106.74(i) to read .. initial listing of off premise signs on <br />registration forms filed by January 1, 2003. Carol Barrett, Director of <br />Planning and Development Services, stated staff has been working on a list <br />of off-premise signs. Mr. Mark Taylor stated this language is already <br />incorporated in Section 106.074(f) (1). Mr. Mihalkanin withdrew his <br />motion. Mr. Thomaides stated he thinks the maintenance of signs should be <br />strengthened. Mr. Thomaides moved to amend the Ordinance to include the <br />changes from Mr. Mark Taylor's Memo dated June 19, 2003 and Ms. Narvaiz <br />seconded the motion. Mr. Taylor inquired whether 10 days was reasonable <br />to change the face of a sign with current information. Mr. Mihalkanin <br />inquired whether this amendment would include the Convention and Visitors <br />Bureau sign. Mr. Mark Taylor stated yes, this Ordinance would include the <br />CVB sign. Ms. Narvaiz stated CVB changes their sign quarterly. Mayor <br />Habingreither stated he does not feel 10 days is a reasonable time frame <br />to replace the face of a sign. Mr. Diaz stated he feels it is more <br />reasonable to give 30 days to replace the face of a sign. Mr. Thomaides <br />and Ms. Narvaiz both withdrew their motions. Mr. Thomaides moved to amend <br />Section 106.009(a) to change 10 days to 30 days. Mr. Thomaides withdrew <br />his motion. Mr. Mihalkanin moved to amend Section 106.071(d) to delete <br />and between painting, and cleaning, Ms. Narvaiz seconded the motion, which <br />passed unanimously. Mr. Mihalkanin moved to amend the Ordinance by <br />separating Section 106.009 into (a) (b) (c) and in (c) add if it is <br />maintained in good condition, and Ms. Narvaiz seconded the motion, which <br />passed unanimously.
