<br />employees, or Plaintiff relating in any manner to Plaintiffs employment with the City <br />and/or the facts alleged in Cause Nos. 96-0953 and 96-CA-706-SS, either directly or <br />indirectly. The parties have negotiated this Agreement in full knowledge of the <br />possibility of additional claims or injuries, and intend this Agreement to settle and <br />finally dispose of all such claims or injuries arising out of or relating in any manner <br />to Plaintiffs employment with the City and/or the facts alleged in Cause Nos. 96-0953 <br />and 96-CA-706-SS, either directly or indirectly. <br />The City and Liner assert, and Plaintiff acknowledges and stipulates, that <br />nothing in this Agreement is an admission of any liability whatsoever; that in fact the <br />City and Liner deny liability for Plaintiffs allegations; and that they have entered <br />into this Agreement solely to keep the peace and avoid the expense of litigation. <br />By this Agreement, Plaintiff, the City, and Liner are compromising, settling <br />and releasing claims disputed in good faith. <br />For good and valuable consideration, the receipt and sufficiency of which is <br />hereby acknowledged, Plaintiff and Defendants agree as follows: <br />1. The City agrees to reclassifY Plaintiffs indefinite suspension as a <br />resignation. This agreement is made with the express understanding that it is in no <br />way, and is not intended to be, an admission of liability in any fashion whatsoever <br />regarding Plaintiffs allegations, nor is it made for any purpose other than to buy <br />peace and avoid litigation. <br />2. The City further agrees to notify the Texas Commission on Law <br />Enforcement Officer Standards and Education ("TECLOSE") of this classification <br />change. <br />Compromise, Settlement and Release Agreement Page 3 <br />f-89707.1 <br />
