<br />3. Plaintiff agrees to this reclassification of his indefinite suspension as a <br />resignation in full satisfaction of all claims against the City and Liner, whether <br />asserted or unasserted, known or unknown, relating in any manner to Plaintiff's <br />employment with the City and/or the facts alleged in Cause Nos. 96-0953 and <br />96-CA- 706-88, either directly or indirectly. <br />4. Plaintiff agrees and stipulates that he shall never apply for re- <br />employment with the City. <br />5. Plaintiff agrees to execute and file an Agreed Motion to Dismiss Cause <br />No. 96-0953, with corresponding Order. The Dismissal and corresponding Order will <br />be in the same form as the copy which is attached as Exhibit "A." <br />6. This Agreement extinguishes all rights, if any, which Plaintiff may have, <br />and obligations, if any, which the City and Liner may have, contractual, statutory, <br />common-law or otherwise, prior to the execution of this Agreement. <br />7. Plaintiff further agrees and stipulates that this Agreement constitutes <br />a complete waiver and releases the City and Liner, and all of their predecessors, <br />successors, assigns, heirs, executors, administrators, elected officials, appointed <br />officials, agents, officers, directors, affiliates, employees, and legal representatives, <br />and all persons, natural or corporate, in privity with them or any of them, from all <br />liability resulting from Plaintiffs allegations in Cause Nos. 96-0953 and <br />96-CA- 706-88, or any other matters surrounding Plaintiffs employment with the <br />City, either directly or indirectly. <br />Compromise, Settlement and Release Agreement Page 4 <br />f-89707.1 <br />
