<br /> VOl 176PACE618 <br /> -9- <br /> remedies provided or granted to a secured party after default under the Uniform <br /> Commercial Code ("UCC") with respect to any and all such property, including, <br /> without limitation, the right to take and retain possession of any or all property and <br /> to sell or otherwise utilize same at public or private sale or in any other manner <br /> authorized or provided in the UCC. Upon request by Lessor, Lessees agree to <br /> execute and deliver to Lessor from time to time UCC Financing Statements as <br /> Lessor may deem necessary to perfect the security interest of Lessor in the <br /> property and any proceeds under the provisions of the UCC in force in the State of <br /> Texas. <br /> ARTICLE 15. <br /> Operation of the Airport <br /> 15.1 Lessor reserves the right to operate the Airport in accordance with, and this Lease <br /> is subordinate to, the Lessor's obligations to the Federal or State Government <br /> under any of the agreements for which aid for development was granted; however, <br /> if the operation unreasonably restricts the operation of Lessees on the Leased <br /> Premises, appropriate rental reductions shaH be negotiated. In the event that <br /> appropriate rental reductions cannot be negotiated between the parties, then this <br /> Lease shall terminate and the parties shall have no further obligations. <br /> 15.2 It is specifically understood and agreed that nothing contained in this Lease shall <br /> be construed as a granting or authorizing the granting of an exclusive right for <br /> exercising an aeronautical activity which is illegally discriminatory, and Lessees <br /> specifically agree to operate a non-discriminatory operation. Lessees, their agents <br /> and employees, will not discriminate in any manner prohibited by Federal Aviation <br /> Administration or Texas Department of Transportation Regulations. Lessees further <br /> agree to comply with any enforcement procedures as might be required by the <br /> United States of America or the State of Texas. <br /> 15.3 Lessor reserves the right to take any action it considers necessary to protect the <br /> aerial approaches of the Airport against obstructions; and to limit the Lessees from <br /> erecting or permitting to be erected any building or structure on the Airport and on <br /> the Leased Premises that would limit the usefulness of the Airport or that would <br /> constitute a hazard to aircraft. <br /> 15.4 Lessor reserves the right to further develop the Airport as it sees fit regardless of <br /> the desires of the Lessees, and without any hindrance or interference from the <br /> Lessees. Lessor expressly reserves the right to grant leases and privileges to other <br /> individuals with respect to the Airport facility, even though the purposes for which <br /> these leases are given are the same and duplicate those contained in this Lease. <br /> If the development of the Airport requires the relocation of the Lessees, the Lessor <br /> agrees to provide a location comparable to that provided to other private lessees <br /> at the time of the relocation without any unreasonable interruption to the Lessees' <br /> activities, and agrees to relocate buildings owned by the Lessees, or provide similar <br /> facilities for the Lessees at no cost to the Lessees, except that Lessor shall not be <br /> required to pay more than the wholesale cost of foundation materials. <br /> 15.5 This Lease shaH be subject to and in conformance with all City, State and Federal <br /> ordinances, statutes and regulations. <br /> 15.6 The Lessees, for themselves, their personal representatives, successors in interest, <br /> and assigns, as part of the consideration, covenants and agrees as a covenant <br /> running with the land that: (1) no person on the grounds of sex, race, creed, color, <br /> or national origin shall be excluded from participation in, denied the benefits of, or <br /> be otherwise subjected to discrimination in the use of the Leased Premises, (2) that <br /> in the construction of any improvements on, over, or under the Leased Premises <br /> and the furnishing of services, no person on the grounds of sex, race, creed, color, <br />
