VOL 176PAcf619 -10- or national origin shall be excluded from participation in, denied the benefits of, or otherwise be subjected to discrimination, and (3) that the Lessees shall use the premises in compliance with all other requirements imposed by or pursuant to 49 CFR Part 21, Nondiscrimination in Federally Assisted Programs of the Department of Transportation, as amended. 15.7 The Lessees assure that it will undertake an affirmative action program as required by 14 CFR Part 152, Subpart E, to ensure that no person shall on the grounds of race, creed, color, national origin, or sex be excluded from participating in any employment activities covered in 14 CFR Part 152, Subpart E. The Lessees assure that no person shall be excluded on these grounds from participating in or receiving the services or benefits of any program or activity covered by this subpart. The Lessees assure that they will require that their covered suborganizations provide assurances to the Lessees that they similarly will undertake affirmative action programs and that they will require assurances from their suborganizations, as required by 14 CFR Part 152, Subpart E, to the same effect. 15.8 That in the event of breach of any of the preceding nondiscrimination covenants, Lessor shall have the right to terminate the Lease and to reenter and repossess the Leased Premises in accordance with Article 13. 15.9 During the time of war or national emergency, Lessor shall have the right to lease the landing area or any part of the area to the United States Government for military use, and, if a lease is executed, the provisions of this instrument insofar as they are inconsistent with the provisions of the lease to the United States Government, shall be suspended. ARTICLE 16. Miscellaneous 16.1 Whenever the singular number is used, the same shall include the plural, and the neuter gender shall include the feminine and masculine genders. 16.2 If any clause or provision of this Lease is illegal, invalid or unenforceable under present or future laws, the remainder of this Lease shaH not be affected, and the parties declare that this Lease would have been entered into without such unenforceable portion. 16.3 This Lease may not be altered or amended, except by instrument in writing signed by both parties. The terms, provisions, covenants and conditions contained in this Lease shall apply to, inure to the benefit of, and be binding upon the parties, and upon their respective successors in interest and legal representatives, except as otherwise expressly provided. 16.4 The captions used in this Lease are for convenience only and do not in any way limit or amplify the terms and provisions. 16.5 One or more waivers of any covenant, term or condition of this Lease by either party shall not be deemed as a waiver by that party as to any subsequent similar act or omission. 16.6 Whenever a period of time is prescribed for action to be taken by Lessor, Lessor shall not be liable or responsible for, and there shall be excluded from the computation of any such period of time, any delays due to strikes, riots, acts of God, shortages of labor or materials, war, governmental laws, regulations or restrictions or any other causes of any kind whatsoever which are beyond the reasonable control of Lessor.
