ORDINANCE NO. 2003- /+1 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE C~TY <br />OF SAN MARCOS, TEXAS, AMENDING ARTICLE 4, <br />STOPPING, STANDING PARKING, OF CHAPTER 82, <br />TRAFFIC AND VEHICLES, OF THE SAN MARCOS CITY <br />CODE, TO INCREASE FINES, CLARIFY ENFORCEMENT <br />PROCEDURES AND ADD VIOLATIONS; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />178. <br /> <br />~0~ o <br />0 <br /> <br />RECITALS: <br /> <br /> 1. City of San Marcos Parking fines are significantly lower than Southwest Texas <br />State University parking fines thereby creating an economic incentive to park in the <br />downtown area. <br /> <br /> 2. City of San Marcos parking fines are significantly lower than the surrounding <br />communities surveyed. <br /> <br />3. Parking fines have not been increased since 1998. <br /> <br /> 4. The experience of the city staff, including police and parking technicians, in <br />enforcing the parking regulations has indicated the need for certain procedural changes <br />to the current ordinance. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 82.156 of the San Marcos City Code is amended as follows <br />(underlininq indicates added text, ~ indicates deleted text): <br /> <br />Sec. 82.156. Presumptions regarding person who parked vehicle. <br /> <br /> (a) In any prosecution charging a violation of any law governing the <br />standing or parking of a vehicle under this chapter, proof that the vehicle <br />described in the complaint was standing or parked in violation of the law, <br />together with proof that the defendant named in the complaint was, at the time of <br />the violation, the registered owner of the vehicle shall create a prima facie <br />presumption that the defendant was the person who caused or permitted the <br />vehicle to stand or be parked at the point where and for the time during which the <br />violation occurred.
