that the vehicle was parked by a person other than the defendant as charged in <br />the complaint. <br /> <br /> (b) In any prosecution charging a violation of any law governing time <br />restricted parking of a vehicle under this chapter, proof that the vehicle described <br />in the complaint was parked in the same parking space creates a prima facie <br />presumption that the vehicle was continuously parked in that space. A defendant <br />may introduce evidence, as a defense, to show that the vehicle was not parked in <br />the same space for a continuous period of time. <br /> <br /> (c) In any prosecution charging a person with removing a parking ticket <br />from the vehicle of another or placing a ticket from the vehicle of another on the <br />person's vehicle, proof that the parking ticket found on a vehicle contains <br />identifying information for a different vehicle, together with proof that the <br />defendant named in the complaint was, at the time of the violation, the registered <br />owner of the vehicle upon which the ticket was placed, creates a prima facie <br />presumption that the defendant named in the complaint removed the ticket from <br /> <br />the vehicle of another or placed a ticket from another vehicle on the defendant's <br />own vehicle. A defendant may introduce evidence, as a defense, to show that <br />the ticket found on defendant's vehicle was removed or placed by a person other <br />than the defendant as charqed in the complaint. <br /> <br /> (d) In any prosecution charqin.q use of a prior ticket, proof that the time of <br />issuance on the ticket is more than 24 hours prior to the time the ticket is found, <br />together with proof that the defendant named in the complaint was, at the time of <br />the violation, the registered owner of the vehicle upon which the ticket was <br />placed, creates a prima facie presumption that the defendant named in the <br />complaint placed the prior ticket on the vehicle. A defendant may introduce <br />evidence, as a defense, to show that the ticket was placed on defendant's <br />vehicle by a person other than the defendant as charged in the complaint. <br /> <br />SECTION 2. Current Section 82.159 of the City Code is deleted entirely and replaced <br />with Section 82.159 to read as follows: <br /> <br />Sec. 82.159. Penalties for parking violations. <br /> <br /> (a) A person who violates this article shall be guilty of a misdemeanor and <br />upon conviction shall be subject to a fine of not less than the following: <br /> <br />(1) <br /> <br />Level One Violations - $20.00 <br />Parked Overtime <br />Parked within 20 feet of crosswalk <br />Wheels over 18 inches from the curb <br />Parked on wrong side of the street <br /> <br /> <br />
