<br /> '81) <br />Sixth. By Warranty Deed dated May 5, 19861 recorded in Volume 598, Page <br />4691 Real Property Records, Hays County, Texas, Vallejo conveyed the replatted Lot <br />5-A to Joel D. Gage and wifel Dolores A. Gage, which Deed recites consideration in <br />the form of a loan obtained from United Austin Mortgage Company. As part of that <br />transaction, Seguin Savings released Lot 5-A from both of the liens securing the <br />Vallejo Loans, but continued its lien on the balance of the Vallejo Property. Seguin <br />Savings was later placed in receivership and via various assignments of lien, San Saba <br />became the successor in interest as the owner and holder of the Vallejo Loans. Vallejo <br />defaulted on the Vallejo Loans and San Saba foreclosed and became the owner of the <br />Vallejo Property via Substitute Trustee/s Deed dated October 5, 1993, recorded as <br />Document No. 3464381 Volume 1023, Page 130, Real Property Recordsl Hays <br />County, Texas. <br />Seventh. The results of the foregoing were as follows: <br />1. The improvements constructed from the proceeds of the Vallejo Loans are <br />situated on the 9,0001 Tract in which record title was reflected in Franklin <br />Federal; <br />2. Franklin Federal held record title to the other Ezell Property but without the <br />Replatted Lot 6-B access tract; and <br />. <br />3. San Saba owned the Vallejo Property, less Lot 5-A, which did not include <br />the improvements constructed with the proceeds of the Vallejo Loans. <br />Eighth. Franklin Federal no longer needed access through the Vallejo Property <br />and has quitclaimed to San Saba all of its rights, title, and interest in and to Lot 6-A <br />and Lot 6-8 by document entitled MUTUAL RELEASE OF CLAIMS dated July 27, <br />1994, recorded under Document No. 3696531 Volume 11121 Page 407, Real Property <br />Records, Hays County, Texas. <br />Ninth. On July 271 1994, Franklin Federal conveyed to San Saba the 9/000' <br />Tract {actually 9,055/L upon which are situated the improvements constructed with <br />the proceeds of the Vallejo Loans, by Special Warranty Deed recorded under <br />Document No. 3696521 Volume 1112, Page 402, Real Property Recordsl Hays <br />County, Texas. <br />Tenth. The City of San Marcos has quitclaimed any right, title 1 and interest in <br />the R.O.W. Tract held either by the City or by the public, by Quitclaim dated <br />.:T~u~ ~ ¡'If&. and recorded under Document No. ~.3æ~ , Real Property <br />Recordsl Hays County, Texas; which Quitclaim constitutes part of the Consideration <br />for this Ratification. <br />Page 3 <br />
