Morris and <br /> City Council Members <br /> FROM: <br /> Charter Review Commission <br /> SUBJECT: <br /> Report of the 1995-96 Charter Review Commission <br /> DATE: <br /> January 11, 1996 <br /> The 1995-96 Charter Review Commission conducted eight meetings since September to <br /> review the San Marcos City Charter and offers the following recommendations for <br /> amendments to the Charter. Shadowing indicates added language, and overstriking <br /> indicates deleted language. Some of the provisions are completely rewritten. <br /> 1. Amend Section 3.02(a)(4) regarding qualifications for serving on the City Council as <br /> follows: <br /> (4) Shall not be an officer or director of any public utility service company within <br /> the city, or outside "Jithout the city but serving inhabitants of the city, nor be <br /> the owner or proprietor of any public utility service company in the city. A <br /> pPublic utility service company 3hould be defined a3 is any company, <br /> individual, partnership, corporation or other entity recognized by law that-;-ffi <br /> the cour3e of it3 principal bu3inc3s, uses any of the city's streets, alleys, <br /> highways or grounds to carry out its primary purpose, including but not <br /> limited to tran3portation, sale, or U3e of water, sewer, ga~, electricity, <br /> telecommunications, conduit, telegraph, telephone commercial railway or <br /> street railway services. <br /> These changes are to ensure uniform use of the term "public utility" throughout the Charter, <br /> and to simplify the current wording. <br />
