205. <br />Regular Meeting July 14, 2003 Page 4 <br /> <br />Council then voted unanimously for the confirmation of Police Chief Howard <br />Williams. <br /> <br />Mayor Habingreither introduced a public hearing regarding an Annexation, <br />the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 26.26 ACRES, MORE OR <br />LESS, LOCATED OFF OF AND SOUTHEAST OF THE 2200 BLOCK OF IH-35 NORTH <br />(HOLT TRACT); APPROVING A SERVICE PLAN FOR THiS TRACT; PROVIDING FOR <br />PUBLICATION; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished <br />to speak. 1) Dianne Wassenich stated she feels this conveyance of parkland <br />is a good example of how to preserve greenspace. No one else wished to <br />speak, so Mayor Habingreither closed the public hearing. <br /> <br />Mayor Habingreither introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANENDING THE 2002-2003 CITY BUDGET TO PROVIDE FUNDING FOR SETTLEMENT <br />OF THE BURKETT V. CITY OF SAN MARCOS SUIT; AND DECLARING AN <br />EMERGENCY. <br /> <br />Mr. Mihalkanin moved for adoption of the Ordinance on emergency and Mr. <br />Montoya seconded the motion. Mr. O'Leary stated this is an Ordinance <br />providing funding for a settlement agreement of the contract dispute <br />between Burkett Transit Advertising and the City. The City will pay <br />$25,000.00 in exchange for the removal of the benches, and Texas Municipal <br />League Intergovernmental Risk Pool will pay $10,000.00. He stated if this <br />Ordinance is adopted, this will allow the settlement agreement to be <br />promptly implemented. On roll call the following vote was recorded. <br /> <br />AYE: <br /> <br />Thomaides, Mihalkanin, Habingreither and Montoya. <br /> <br />NAY: Taylor. <br /> <br />ABSTAIN: Narvaiz and Diaz. <br /> <br />Motion fails on emergency, but passes on approval on first reading. See <br />Page 8 for a reconsideration. <br /> <br />Mayor Habingreither introduced for consideration reconsideration of a <br />Zoning Ordinance.
