Sec. 106.010. Nonconforming signs. <br /> <br />(a) A sign existing on the effective date of the ordinance from which this chapter was derived <br />that violates this chapter or any other ordinance, and a sign that comes under the jurisdiction of <br />this chapter due to the expansion of the city is a legal nonconfom~ing sign and may be continued, <br />repaired and maintained in good condition, bnt may not be otherwise altered. <br /> <br />(b) Except as permitted for specific types of signs, voluntary removal of a nonconforming sign <br />for purposes other than maintenance terminates nonconforming rights for the sign. <br /> <br />(c) An off-premises sign existing on July 24, 2003 that violates a spacing or location restriction <br />in section 106.074~ and an existing off-premises sign that thereafter becomes in violation of a <br />spacing or location restriction in section 106.074, is a legal nonconforming sign and may be <br />continued, repaired and maintained in good condition, but may not be otherwise altered. A <br />nonconforming off-premises sign will have its nonconforming status terminated if the sign, or <br />a substantial part of it, is blown down or otherwise destroyed, or dismantled for any purpose <br />other than routine maintenance or for changing the letters, swnbols, or other matter on the sign. <br />For purposes of this subsection, a sign is considered to have been destroyed only if the cost of <br />repairing the sign is more than 60 percent of the cost of erecting a new sign of the same type, <br />material, and dimensions at the same location. <br /> <br /> SECTION 3. Section 106.071 of the City Code is an~ended as follows (underlining <br />indicates added text and z¥crztr[!ce indicates deleted text): <br /> <br />Sec. 106.071. Construction and maintenance. <br /> <br />(a) Ali permanent signs shall comply with the city building and electrical codes. <br /> <br />(b) The design of freestanding signs over 25 feet in height above ground level shall be certified <br />by a professional engineer for structural integrity. <br /> <br />(c) Electric signs shall have an accessible disconnect switch and shall be labeled to indicate the <br />voltage and amperage of electrical circuits connected to the sign. <br /> <br />(d) Signs shall be maintained in good condition, including replacement of defective or missing <br />parts, painting, and cleaning, and replacement or covering of sign faces that exhibit dmnage or <br />deterioration. <br /> <br />(e) A sign determined to be a hazard to public health and safety shall be subject to enforcement <br />under section 106.004. <br /> <br /> SECTION4.
