<br /> . þ 46 <br /> . . . <br /> This AGREEMENT is made this the 25th day of March , 199QL between <br /> the CITY OF SAN MARCOS, TEXAS, (the "CITY"), 630 East Hopkins, San Marcos, Texas <br /> 78666 and DOUGLAS HEARN, P.E, RP.L.S., (the "ENGINEER") 5 Woodland Loop, <br /> Round Rock, Texas 78664, for engineering services for the Blanco Street Drainage <br /> Improvements Project (the "Project"). <br /> The CITY and the ENGINEER agree as follows: <br /> .= ARTICLE 1 <br /> I ENGINEER'S SERVICES AND RESPONSIBILITIES <br /> 1.1 STANDARDS OF PERFORMANCE <br /> 1.1.1 ENGINEER will be responsible for the proper, accurate and adequate design and <br /> preparation of plans and specifications and other construction contract documents and for <br /> contract administration for the Project. <br /> 1.1.2 Any provisions in the Agreement pertaining to the CITY's review, approval and lor <br /> acceptance of plans, specifications, construction contract documents, or other written <br /> materials prepared by ENGINEER andlor its consultants, contractors, and subcontractors <br /> in connection with this Project will not diminish ENGINEE~'s responsibility therefor. The <br /> ENGINEER's Basic Services will consist of the services described in Sections 1.1 through <br /> 1.4 and include normal, structural, mechanical, civil and electrical engineering services. <br /> 1.1.3 The performance of all engineering services in connection with this Agreement will <br /> be by persons appropriately licensed or registered under State laws governing the practice <br /> of engineering. The ENGINEER will use that degree of care and skill ordinarily exercised <br /> for similar projects by professional engineers who possess special expertise in the type of <br /> work involved in this Project. No work under this Agreement will be subcontracted by the <br /> ENGINEER without prior written approval from the CITY. Any work or services <br /> f - subcontracted hereunder will be specified by written Agreement and will be subject to each <br /> 1 provision of this Agreement. <br /> 1.2 PHASE 1 - SCHEDULING, DESIGN AND BIDDING <br /> 1.2.1 The ENGINEER will meet with the CITY representative to set the design and <br /> production schedule and parameters for all subsequent work, to verify the components <br /> within which all Project participants must perform, and to identify all parties and significant <br /> deadlines involved in the comprehensive schedule strategy. Based on this information, the <br /> ENGINEER will prepare a detailed schedule of its work for the Project addressing each <br /> component of the work to be done, indicating the points of involvement of all project <br /> participants. The ENGINEER will conduct weekly progress meetings between the CITY <br /> representative and the Contractor during the Construction Administration Phase. <br /> 1.2.2 ToDographic Survey <br /> <br /> - <br />
