'. ~ -~ - <br />JJ...'---' .......;;r... <br />~' ~& <br />ORDINANCE 1996 - 11 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, RESTRICTING THE CARRYING OF FIREARMS ON <br />CITY PROPERTY BY AMENDING CHAPTER 58, ARTICLE 4, DIVISION 1 <br />OF THE SAN MARCOS CITY CODE; INCLUDING PROCEDURAL <br />- PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. The 74th Legislature of the State of Texas amended Title 70 of the Revised Civil <br />Statutes by adding Article 4413 (2gee), more commonly referred to as the "Texas <br />Concealed Handgun Law," which became effective September 1, 1995, and which <br />sets forth regulations for carrying concealed handguns. The statute allows <br />businesses, both public and private, to prohibit persons who are licensed under <br />Article 4413 (2gee), from carrying a concealed handgun in any building or portion <br />of a building owned by the business, <br /> <br />2. The City Council of the City of San Marcos now finds and determines that it is in <br />the best interest of the City and for the public's health and s~fety, to prohibit the <br />carrying of weapons on city premises. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1, That San Marcos City Code Chapter 58, Public Facilities, Parks <br />and Recreation, Article 4, Division 1, is amended to read as follows: <br /> <br />DIVISION 1. WEAPONS. <br />I <br /> <br />Sec. 58.096 Definitions. <br /> <br />In this division: <br /> <br />Air gun means an air gun, air pistol, air rifle, or any other device using air pressure <br />to propel a projectile through a barrel. <br /> <br />Building has the same meaning as V.T.C,A., Penal Code, Chapter 30, <br /> <br />City premises means a building or any portion thereof, and real property or any <br />portion thereof, owned, leased, occupied or controlled by the City. "City Premises" does <br />not include streets, sidewalks, parking areas or public parks owned or operated by the <br />City. <br /> <br />Enter or entry means the intrusion of the entire body, <br /> <br />Firearm means: (1) a gun, pistol, rifle, or any other device designed, made or <br />adapted to expel a projectile through a barrel by using <br />explosive energy generated by an explosion or burning <br />substance or any device readily convertible to that use; or <br /> <br />(2) an air gun <br /> <br />Notice has the same meaning as in V.T.C,A., Penal Code, Section 30.05, <br />
