<br /> ð'rll <br /> Sec. 58.097 Weapons prohibited on city premises; notice. <br /> (a) A person carrying a firearm, whether or not the firearm is concealed or <br /> licensed, may not enter or remain on city premises. <br /> (b) The city manager is authorized and directed to provide notice at all city <br /> premises that entry is forbidden to anyone carrying a firearm nòt permitted <br /> [ by this division. This notice will include a statement, in English and <br /> , <br /> Spanish, to read substantially as follows: <br /> Entry onto these premises while carrying a firearm, whether or not the <br /> firearm is concealed or licensed, is prohibited, and may subject you to <br /> prosecution for Criminal Trespass under the Texas Penal Code, <br /> (c) All city officers and employees are authorized and directed to provide notice <br /> to anyone found carrying a firearm not permitted by this division, to depart <br /> city premises, <br /> Sec. 58.098 Defenses. <br /> It is a defense to prosecution for Criminal Trespass under Section 58.097(a) above <br /> if the person carrying a firearm onto city premises is: <br /> (1) A peace officer or a commissioned security officer employed by or under <br /> contract with the city and acting within the scope of that employment or a <br /> peace officer of another unit of government, lawfully acting within the scope <br /> of the peace officer's duties. <br /> (2) A person who transports, demonstrates or displays a firearm for purposes <br /> of show or sale on city premises at an event approved by the city manager <br /> or the city manager's designee, 'and in accordance with restrictions <br /> prescribed by the city manager or the city manager's designee. <br /> (3) A person who carries a firearm on the premises of the airport for purposes <br /> of shipping the firearm by air or receiving a shipment of the firearm, in <br /> accordance with restrictions prescribed by the airport manager or the airport <br /> manager's designee, and in compliance with applicable federal regulations. <br /> SECTION 2. That if any word, phrase, clause, sentence, or paragraph of this <br /> ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br /> remaining provisions of this ordinance shall remain in effect as if the unconstitutional or <br /> invalid portion had not been adopted. <br /> SECTION 3. That all ordinances and resolutions or parts of ordinances or <br /> resolutions in conflict with this ordinance are repealed. <br /> SECTION 4. That any person violating any provision of this ordinance shall be <br /> deemed guilty of a misdemeanor and upon conviction shall be subject to the penalties as <br /> provided in V.T.C.A., Penal Code. <br /> I <br /> ! SECTION 5. That this Ordinance shall be in effect ten (10) days from and after <br /> its passage, and it shall be published in a newspaper of general circulation in the area as <br /> required by the Charter of the City of San Marcos, Texas. <br /> PASSED AND APPROVED on first reading March 25, 1996. <br /> PASSED AND APPROVED on second reading April 8, 1996. <br />
