<br /> - . 107 <br /> INTERLOCAL AG-REEjyIENT <br /> BETWEEN THE CITY OF SAN jylARCOS AND <br /> GUADALUPE-BLANCO RIVER AUTHORITY <br /> This Interlocal Agreement (this "Agreement") is made and entered into as of the .LL day <br /> of April, 1996, by and between the City of San Marcos, Texas ("San Marcos") and the <br /> Guadalupe-Blanco River Authority ("GBRA"). <br /> - <br /> i <br /> I RECITALS <br /> San Marcos and other entities in the San Marcos area have an urgent need for alternative <br /> sources of water. This need, in large part, is prompted by the need to limit withdrawals of water <br /> from the Edwards Aquifer to the extent necessary to protect the quality of water in the Aquifer, <br /> adequate minimum springflows from the Carnal and San Marcos Springs, and adequate <br /> minimum flows in the San Marcos and Guadalupe Rivers downstream of the Springs. <br /> San Marcos and GBRA together have made a substantial effort to achieve the necessary <br /> regulation of withdrawals of water from the Edwards Aquifer, and they will continue that effort. <br /> San Marcos and GBRA thus far have also taken certain actions, togèther or separately, in <br /> their respective efforts to provide a surface water supply to San Marcos and other entities in the <br /> San Marcos area. These actions include the following: San Marcos and GBRA have entered into <br /> a water supply contract by which GBRA agrees to supply to San Marcos 5,000 acre-feet of water <br /> per year from Canyon Reservoir (the "Canyon Contract"); San Marcos has filed an application <br /> for a permit under Section § 11.121 of the Texas Water Code to di vert and use unappropriated <br /> flows of the San Marcos River and the construction of an off-channel reservoir ("San Marcos' <br /> § 11.121 Application"); and San Marcos has also filed an application for a pemit to utilize the <br /> bed and banks of the San Marcos River to convey wastewater effluent from the point of <br /> discharge of San Marcos' wastewater treatment plant to a proposed point of diversion on the San <br /> Marcos River downstream of the point of discharge, to the extent such effluent is derived from <br /> water withdrawn by San Marcos from the Edwards Aquifer ("San Marcos' Bed and Banks <br /> Application"). <br /> San Marcos and GBRA now desire to expedite the development of a regional project (the <br /> "San Marcos Regional Project" or the "Project") to provide adequate quantities of surface water <br /> to San Marcos and other entities in the San Marcos area. <br /> A G REEiYŒNT <br /> IN CONSIDERATION of the foregoing and the mutual benefits and agreements <br /> contained herein, San Marcos and GBRA agree as follows: <br />
