<br /> / () 7A- <br /> 1. Description of the Project. The Project will include a regional water treatment <br /> plant and facilities for the diversion and conveyance of raw water from Lake Dunlap on the <br /> Guadalupe River to the treatment plant. These diversion and conveyance facilities may include <br /> the use of existing SCS flood control structures along the proposed transmission line from Lake <br /> Dunlap. The Project may also include facilities for the diversion and conveyance of water from <br /> the San Marcos River to the regional water treatment plant. <br /> 2. Joint Development of Project. San Marcos and GBRA agree to jointly pursue <br /> development of the Project. Immediately following execution of this Agreement, San Marcos <br /> and GBRA will pursue development of the necessary detailed agreement(s) (the "Project <br /> Agreement(s)") between themselves and other participating entities in the San Marcos area. <br /> Project initiation will commence following execution by all necessary parties of the Project <br /> Agreements(s). The Project Agreement(s) shall provide for ajoint Project Management <br /> Committee. <br /> 3. Expeditious Development of Initial Sta2e. The Project shall be developed in <br /> stages, and the initial stage shall be developed as expeditiously as possible. In order to be able to <br /> develop the initial stage expeditiously, that stage shall be based on currently-available supplies of <br /> surface water under existing permits and contracts, and under permits and contracts that can be <br /> obtained quickly. The source of water for the initial stage shall be water released from Canyon <br /> Reservoir and diverted from Lake Dunlap on the Guadalupe River, and possibly, in addition, <br /> water diverted from the San Marcos River. . <br /> 4. Additional Comnútment from Canvon Reservoir. The extent to which <br /> additional water from Canyon Reservoir (water in addition to the 5,000 acre-feet per year <br /> currently committed under the Canyon Contract) will be committed to the project, and the extent <br /> to which the timing of any such additional commitment will be based on expansion of the Project <br /> beyond the initial stage, will be addressed in the Project Agreement(s). <br /> 5. Possible Diversions from the San Marcos River. Whether, and the extent to <br /> which water from the San Marcos River should be supplied to the Project in addition to water <br /> from Canyon Reservoir, will be determined by San Marcos and GBRA and set forth in the <br /> Project Agreement(s). In this regard, immediately upon execution of this Agreement, San <br /> Marcos will request that the Texas Natural Resource Conservation Commission ("TNRCC") <br /> continue its processing of San Marcos' § 11.121 Application to the point at which the TNRCC <br /> staff determines that application to be administratively complete; upon such determination, <br /> however, San Marcos will request that no notice be issued by the TNRCC regarding San Marcos' <br /> § 11.121 Application unless and until San Marcos requests otherwise; and, any further 'action on <br /> that application shall be determined by San Marcos based on requirements of the TNRCC or <br /> provisions of the Project Agreement(s). GBRA encourages participation in the ongoing instream <br /> flow study being conducted by Texas Parks and Wildlife and GBRA by San Marcos and other <br /> entities with significant interests in the water resources in the Guadalupe River Basin, and San <br /> Marcos will participate to the extent set forth in the Project Agreement(s). Unless the Project <br /> Agreement(s) provide otherwise, San Marcos may pursue its Bed and Banks Application prior to <br /> completion of the instream flow study and, if San Marcos chooses to do so, GBRA will support <br /> such efforts. <br />
