<br /> . /0713 <br /> 6. Design. Acquisition. Construction. Financing and Ownership. The respective <br /> rights, obligations and interests of San Marcos and GBRA relating to design, construction, <br /> financing and ownership of each of the various facilities, lands and other property interests <br /> comprising the Project shall be detennined by San Marcos and GBRA and set forth in the Project <br /> Agreement(s). GBRA'S interest in the regional water treatment plant will be on behalf of all <br /> participants other than San Marcos. The respective interests of San Marcos and GBRA in the <br /> plant shall be based on appropriate water need projections and engineering analyses. The design, <br /> acquisition, construction and financing will be overseen by the Project Management Committee. <br /> 7. Operation of Facilities. Upon completion of construction, GBRA will operate <br /> all diversion and conveyance facilities. The operator of the regional water treatment plant shall <br /> be detennined by San Marcos and GBRA and set forth in the Project Agreement(s). The <br /> operation will be overseen by the Project Management Committee. <br /> 8. Public Information. San Marcos and GBRA agree to disseminate infonnation to <br /> the public regarding this Interlocal Agreement and the San Marcos Regional Project jointly, <br /> whenever feasible, and will support and assist each other in developing and implementing their <br /> respective public infonnation programs. <br /> 9. Termination of Agreement. This Agreement shall terminate on September 1, <br /> 1996, unless it is extended by written agreement of San Marcos and GBRA. Subject to San <br /> Marcos, GBRA and other participating entities in the San Marcos area reaching agreement on the <br /> tenns and conditions of the Project Agreement(s), San Marcos and GBRA anticipate that this <br /> Agreement will be superseded by execution, prior to September 1, 1996, of the Project <br /> Agreement( s). <br /> IN" \VITNESS WHEREOF, this Agreement is executed on behalf of San Marcos and <br /> GBRA by their respective authorized officers, in multiple counterparts, each of which shall <br /> constitute an original. <br /> CITY OF SAN MARCOS, TEXAS <br /> By ?:, - (/; :1/ <br /> 1,-"'_- //1 /7";"""/ <br /> Lar-rfD.
