<br /> , <br /> .' - <br /> 1.3 <br /> LEASE AGREEMENT BETWEEN <br /> THE CITY OF SAN MARCOS AND THE <br /> SAN MARCOS YOUTH SOCCER ASSOCIATION <br /> THE STATE OF TEXAS <br /> COUNTY OF HAYS <br /> f This Lease Agreement is between the City of San Marcos, a municipal corporation <br /> I (the "City") and the San Marcos Youth Soccer Association, a nonprofit association (the <br /> I "Associ ation"). <br /> 1. GRANT OF LEASE <br /> In consideration of the construction by the Association of a concession stand, <br /> restroom, and storage facility (the "Concession Building"), and the operation of this facility <br /> and management of a youth soccer program by the Association at the Gary Park Soccer <br /> Complex (the "Complex"), consisting of the 9.48 acre, more or less, tract of property in the <br /> City of San Marcos, Caldwell County, Texas, as depicted on the attached Exhibit "A", the <br /> City grants a lease of the Complex to the association for socce~ games played under the <br /> supervision of the Association. <br /> . <br /> 2. USE OF PREMISES: LEASE PERIOD <br /> The Association will have exclusive use of the Concession Building year round and <br /> may allow use of this building by other programs with the Association's permission. The <br /> lease period for the remainder of the Complex shall be from September 1 st through <br /> December 31 st of each year of the lease. <br /> 3. TERM <br /> -- The term of this lease shall be for a period of 5 years from June 1, 1996, with two <br /> consecutive 5 year renewable options. The exercise of these options is subject to approval <br /> by the City Council of the City. <br /> 4. RESTRICTIONS ON TIME OF USE: CITY USE OF PREMISES <br /> This lease constitutes the grant to the Association of a right of first priority to use the <br /> Complex from September 1 st to December 31 st each year. The Association agrees that <br /> none of its games or activities will be allowed to begin after 9:00 p.m. <br /> The Association agrees that the Complex may be used for other City-sanctioned <br /> activities or Association-approved activities during any period when the Association is not <br /> using the Complex, provided that participants in these activities shall have the Association's <br />
