<br /> " <br /> 134- <br /> -2- - <br /> or the City's approval. The City shall repair any damage that occurs to the Concession <br /> Building resulting from City-sanctioned activities. Damages resulting from Association- <br /> sanctioned activities will be repaired at the Association's expense. <br /> 5. MAINTENANCE: UTILITIES <br /> <br /> -- The Association agrees to maintain the Complex in a condition suitable for the <br /> , playing of soccer games during the lease period each year of this lease. It shall be the <br /> ; <br /> ¡ <br /> ! responsibility of the Association to collect and deposit all refuse from the Complex area <br /> in garbage containers provided by the City and to keep the Complex in a sanitary and <br /> sightly condition at all times during the lease period. The City agrees to provide water, <br /> sewer and electricity services to the Complex at the City's expense. The City agrees to <br /> maintain all other areas of the Gary Park under the City's control outside the Soccer <br /> Complex at all times during the year, and to maintain the Complex during the times of year <br /> other than the lease period. The Association agrees to obtain the City's written approval <br /> before constructing any additional permanent improvements in the Complex. <br /> 6. NONDISCRIMINATION <br /> The Association shall not discriminate on the basis of religion, race, sex, disability <br /> or national origin in the conduct of its activities. <br /> 7. INSURANCE <br /> The Association shall procure insurance against liability arising out of the <br /> negligence or willful misconduct of the Association, the Association's servants, agents or <br /> employees in a minimum amount of $250,000 for injuries to anyone person, and $500,000 <br /> for all injuries to persons arising from each occurrence; and $100,000 for property <br /> : damage. The City shall be named an additional insured under the policy. The policy shall <br /> provide that it may not be canceled or amended without ten (10) days written notice by <br /> registered mail to the City. A certificate of insurance shall be delivered by the Association <br /> to the City within ten (10) days of the execution of this lease and annually thereafter. The <br /> minimum limits of any required insurance shall not limit the Association's liability under <br /> Part 8 of this lease. <br /> 8. INDEMNIFICATION <br /> The Association shall indemnify, defend, and hold harmless the City and all officers, <br /> agents and employees of the City from any and all damages, claims, losses, demands, <br /> suits, judgments, costs, and expenses arising in connection with the construction and <br /> operation of the Concession Building and the use of the Complex by the Association under <br /> the terms of this lease. <br />
