If an existing parking area is not <br />paved, the site plan submitted with the specific use permit application <br />shall be of sufficient detail and scale that it can be determined whether <br />or not the required number of spaces could be provided according to the <br />minimum standards if it were paved. The planning and zoning <br />commission may establish a reasonable period of time, as a condition of <br />the specific use permit, within which existing unpaved parking areas shall ¡- <br />conform to the all-weather surface and dimensional requirements. If the ¡ <br />paved parking is not provided within the time period set by the [ <br />commission, the permit shall be automatically revoked for failure to meet <br />this condition of the permit. <br /> <br />j. Activities shall not occur on the premises of the fraternity/sorority building <br />which result in the issuance of a police citation or the arrest of any <br />person. For penalty point assessment purposes, all citations and arrests <br />resulting from. any .single incident occurring on the premises of the <br />frateriìity/soro'rity öunding shall be treated as a single infraction. The <br />issuance of a citation or an arrest resulting from an incident that is <br />reported to the police by a member or representative of the resident <br />organization shall not cause penalty points to be assessed. (2 points) <br /> <br />k. Activities shall not occur on the premises of the fraternity/sorority building <br />which result in the final conviction of any person for an incident which <br />involves personal injury or death, or sexual assault. (6 points) <br /> <br />I. In addition to the conditions provided in subsections (d)(3)a, through <br />(d)(3)k of this section, other relevant requirements may be established by <br />the planning and zoning commission as a condition of approval of the : <br />specific use permit based updn the particular characteristics of the I <br />subject site or surrounding neighborhood. The number of penalty points <br />to be assessed for violation of the condition shall be determined by the <br />planning and zoning commission at the time the condition is established. <br /> <br />SECTION 6. Section 114.618 of the San Marcos City Code is amended to read as <br />follows: <br /> <br />Sec. 114.618. Fences, Walls or Shrubbery; Visibility Obstructions. <br /> <br />Fences, walls or shrubbery in the required front and side yard adjacent to a <br />street shall not obstruct the view of motorists traveling on any street, and <br />shall not inhibit or interfere with the safe movement of vehicular traffic as <br />determined by the chief of police. Fences or walls of any type in residential <br />zoning districts shall not exceed four feet in height in the required front yard <br />or six feet in height in the required interior-side yard, side yard adjacent to a <br />street, and rear yard, nor shall any fence, wall, or shrubbery exceed the limits <br />provided in Sections 114.619 and 114.620. <br /> <br />, -- <br />SECTION 7. If any word, phrase, clause, sentence, or paragraph of this ordinance! <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other i <br />provisions of this ordinance will continue in force if they can be given effect without the ' <br />invalid portion. <br /> <br />SECTION 8. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 9. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction <br />
