<br /> C!V 89 <br /> - <br /> , <br /> , <br /> -: " >~ '9 104 <br /> " , J <br /> .J. ,-J <br /> EASEMENT AG~F4~Il 76 <br /> THIS EASEMENT AGREEMENT is made and entered into to be effective as of <br /> Tu,,\e. ] 3, 1996, between THE FROST NATIONAL BANK, a national banking association, <br /> in its capacity as TRUSTEE OF THE JOSEPH FREEMAN TESTAMENTARY TRUST <br /> ("Grantor"), and the CITY OF SAN MARCOS, TEXAS, a municipal corporation ("Grantee"). <br /> Grantor has contemporaneously herewith executed and delivered to Grantee a deed <br /> conveying to Grantee certain real property in Hays County, Texas, more particularly described in <br /> Exhibit A attached hereto and incorporated herein, for the purpose of constructing and maintaining <br /> an above-ground water tank as part of its water supply and distribution system ("Tank Site"). <br /> Grantee has requested, and Grantor has agreed to grant to Grantee, subject to the terms and <br /> conditions set forth herein, certain easements on property owned by Grantor to provide access <br /> between Ranch Road 12 and the Tank Site, and to permit the installation and maintenance of <br /> underground water distribution and wastewater collection lines, as part of the water supply and <br /> wastewater collection systems of the Grantee, its successors and permitted assigns, from the Tank <br /> Site to and along Ranch Road 12. <br /> NOW, THEREFORE, for and in consideration of the sum ofTEN ax¡d NOll 00 DOLLARS <br /> ($10.00) and other good and valuable consideration, the receipt and sufficiency of which are hereby <br /> acknowledged, Grantor and Grantee agree as follows: <br /> 1. Grant of Easement.
