<br /> , ':"<t} 105 ~t¡A <br /> - -- v u <br /> EASEMENT TRACT III: 0.611 acres, more ~ less, being a 15 foot wide easement <br /> in the John Williams Survey A-490 in Hays County, Texas, and being more <br /> particularly described by metes and bounds in Exhibit D attached hereto and <br /> incorporated herein. <br /> EASEMENT TRACT IV: 0.14 acres, more or less, being a 15 foot wide easement <br /> in the John Maxmillon Survey A-299 in Hays County, Texas, and being more <br /> particularly described by metes and bounds in Exhibit E attached hereto and <br /> incorporated herein. <br /> I <br /> Easement Tracts II, III and IV are herein collectively refeITed to as the "Water and Wastewater Line <br /> I Easements." The Access Easement and the Water and 'Wastewater Line Easements are herein <br /> sometimes collectively refeITed to as the' "Easements." <br /> 2. Purpose of Access Easement. Easement Tract I shall be used only for the purposes <br /> of providing vehicular and pedestrian ingress and egress between Ranch Road 12 and the Tank Site <br /> and constructing, reconstructing, installing, inspecting, maintaining and repairing of underground <br /> water distribution lines as part of the water supply system of the Grantee, its successors and <br /> permitted assigns. <br /> ., Purpose of\Vater and \Vastewater Line Easements. The Water and Wastewater <br /> .J. <br /> Line Easements shall be used only for the purposes of constructing, reconstructing, installing, <br /> inspecting, maintaining and repairing of underground water distribution and wastewater collection <br /> lines, as part of the water supply and wastewater collection systems of the Grantee, its successors <br /> and permitted assigns. <br /> 4. Duration of Easements. The Easements shall continue for as long as such <br /> I <br /> ! Easements are used for the express purposes described above. The Easements shall automatically <br /> I terminate without the necessity of any further act on the part of Grantor, when the water tank and/or <br /> all water distribution and wastewater collection lines in the Easements are abandoned for a <br /> I continuous period of ninety (90) days, or when the purposes of such Easements as described in this <br /> f- Agreement otherwise cease to exist, are abandoned by Grantee for a continuous period of ninety (90) <br /> days, or become impossible of performance. <br /> 5. Warranty. Grantor hereby binds itself, its successors and assigns, to warrant and <br /> forever defend the Easements and rights granted herein to Grantee, its successors and permitted <br /> assigns, against every person lawfully claiming or to claim the same or any part thereof, subject to <br /> the conditions and provisions stated herein. <br /> 6. Reservations From and Exceptions to \Varranty.
