<br /> , . <br /> 99 <br /> - <br /> STATE 0 F TEXAS § <br /> § <br /> COUNTY OF CALDWELL § <br /> LEASE AGREEMENT <br /> THIS AGREEMENT is made and entered into this 25th day of June, 1996, by <br /> and between JACK E. CARTER, of Caldwell County, Texas, whose address is Carter & <br /> Company. P.O. Box 672, Luling, Texas 78648, hereinafter called "Lessor," and the City <br /> of San Marcos WIC Program, whose address is 630 East Hopkins Street, San Marcos, <br /> Texas 78666, hereinafter called "Lessee." <br /> NOW THEREFORE, in consideration of the rents to be paid and the mutual <br /> convenants to be performed, the parties agree as follows: <br /> 1. DESCRIPTION OF LEASED PREMISES: Lessor leases and demises to Lessee <br /> approximately 1,012 square feet of office space located within real property and <br /> improvements situated in Luling, Texas, with the address of 522 Crockett Street. <br /> 2. TERM: The Lessor agrees, and does lease the premises to the Lessee <br /> beginnning on June 1, 1996 and terminating on September 30, 19Q6. <br /> 3. RENEWALS: Lessee shall, by giving written notice to the Lessor on or before <br /> the sixtieth (60th) day prior to the expiration of this Lease, have the option to renew this <br /> Lease for one (1) year under the same terms and conditions and at a rental rate to be <br /> agreed upon by the parties. <br /> 4. HOLDING OVER: If the Lessee remains in possession of the Leased <br /> Premises after the expiration of this Lease, and without the execution of a new Lease, it <br /> shall be deemed to be occupying the Leased Premises as a tenant from month-to-month, <br /> subject to all conditions, provisions, and obligati'ons of this Lease. <br /> - <br /> 5. RENTAL: Lessee shall pay to Lessor rent at the rate of FOUR HUNDRED <br /> and 00/100 Dollars ($400.00) per month for each month during the term of this Lease. <br /> 6. USE OF THE PREMISES: The Leased Premises shall be used to operate <br /> the WIC Program. The Leased Premises shall not be used for any other type of activity <br /> without the express written consent of the Lessor. <br /> 7. QUIET POSSESSION: The Lessor covenants and warrants that the Lessee <br /> has full right and lawful authority to enter into the Leased Premises for the full term as <br /> provided in this Lease. Lessor further covenants and warrants that the Lessee, upon <br /> payment of the rent and performance of all covenants as herein provided, shall peacefully <br /> and quietly have, hold and enjoy the Leased Premises. <br />
