<br /> r <br /> 9'1A <br /> 8. UTILITIES: - <br /> a. Water, gas and electricity charges accrued during the term of this Lease <br /> Agreement for the Leased Premises are included in the monthly rental amount paid by the <br /> Lessee. <br /> b. Telephone expenses, including installation charges, incurred by the <br /> Lessee will be paid by the Lessee. Any telephone equipment purchased by the Lessee <br /> shall belong to the Lessee at the termination of this Lease Agreement. <br /> 9. TAXES: Lessor shall be responsible for the payment of all Ad Valorem taxes <br /> on the Leased Premises. Lessee shall be responsible for the payment of all taxes <br /> assessed against Lessee's personal property located within the Leased Premises. <br /> 10. INDEMNIFICATION AND INSURANCE: <br /> a. Lessee shall indemnify and hold Lessor harmless from any and all claims <br /> (including attorney's fees) of others for injuries to persons or property arising out of <br /> Lessee's negligent conduct of its business operations on the Leased Premises. <br /> b. Lessor shall indemnify and hold Lessee harmless from any and all claims <br /> (including attorney's fees) of others for injuries to persons or prQperty arising out of <br /> defects in or dangerous conditions of the Leased Premises. <br /> c. Lessee shall maintain adequate insurance on Lessee's personal property <br /> located within the Leased Premises. Lessor shall maintain fire and general casualty <br /> insurance on the building and equipment, furniture, fixtures or other property of Lessor <br /> located within the Leased Premises. <br /> d. Lessee agrees to obtain and keep in force, at Lessee's expense, for the <br /> benefit of both Lessor and Lessee, a good and sufficient policy of public liability insurance <br /> with a company authorized to do business in the State of Texas and acceptable to Lessor <br /> to afford protection to the limit of not less than $100,000.00 for anyone person and <br /> not less than $300,000.00 for more than one person for any loss, damage or injury to <br /> persons or property on or about the Leased Premises by virtue of any act or omission on <br /> part of Lessee, it agents, employees, invitees, licensees or other persons whomsoever <br /> who are in, on or about the Leased Premises or any part thereof. It is expressly agreed <br /> that this insurance shall insure any contingent liability on part of the Lessor, if any, in <br /> respect to any such loss, liability, damage or injury. <br /> e.
