<br /> . .' ql{þ <br /> Upon default, Lessor shall have the right to immediately re-enter and take <br /> possession of the Leased Premises, by summary proceedings or otherwise. If the Lessee <br /> or his successors or assigns refuse to surrender the Leased Premises, the Lessor may use <br /> such force as may be reasonably necessary to regain possession of the Leased Premises <br /> and to remove all persons therefrom. The Lessor shall have the right to institute the <br /> statutory action of forcible entry and detainer. <br /> Upon re-entering the Leased Premises, the Lessor may remove all or any part of <br /> - Lessee's property remaining on the Leased Premises and store the same at Lessee's <br /> expense. <br /> Upon any default by Lessee, all unpaid rentals, matured and unmatured, shall <br /> immediately mature and be due and payable subject to mitigation of such amounts owed <br /> through sub-letting the premises and any offsets which are applicable. <br /> The pursuit of anyone or more of the above remedies shall not deprive Lessor of <br /> the right to pursue any other remedies as provided by law. <br /> 18. NOTICES: All notices required to be given under this Lease or under law, <br /> shall be sent to the San Marcos City Manager via certified mail, return receipt requested, <br /> and shall be deemed delivered on the date received by the party receiving the notice as <br /> evidenced on the return receipt. Box 672 <br /> Lulng, Texas 78648 <br /> Lessee: City Manager <br /> WIC Program <br /> 630 East Hopkins Street <br /> San Marcos. Texas 78666 . <br /> 19. BINDING EFFECT: This agreement shall be construed under the laws of the <br /> State of Texas and shall be binding upon both parties and their respective heirs, assigns, <br /> successors, executors and administrators. <br /> 20. VENUE: Venue shall lie in Hays County. Texas for any dispute arising under <br /> this Lease Agreement. <br /> IN WITNESS WHEREOF, LESSOR and LESSEE have executed this lease <br /> agreement in duplicate this 25th day of June ,1996. <br />
