252. <br />Regular Meeting July 23, 2003 Page 3 <br /> <br />Mayor Habingreither introduced the Staff Report. 1) Mr. O'Leary thanked <br />the Blanco neighborhood for being present. He stated with new state <br />regulations, these modular homes can spread throughout the City and could <br />happen in many neighborhoods. He stated the State has allowed this to <br />happen and Cities hands are tied. 2) Mr. O'Leary stated a colored map has <br />been provided to indicate the area ordered to boil water due to potential <br />contamination in the water system. He stated during construction in <br />Willow Creek, a 16" waterline was struck and lowered the pressure in these <br />areas. He also stated employees went door to door to inform the <br />neighborhoods, and some restaurants were forced to temporarily close. <br /> <br />Mayor Habingreither introduced an Executive Session pursuant to the <br />Government Code, Section 551.071, to seek the City Attorney's advice <br />regarding litigation, contemplated litigation, a settlement offer, or a <br />matter involving attorney-client privilege (Wastewater Treatment Plant <br />Analysis). Ms. Narvaiz moved the Council adjourn into Executive Session at <br />7:52 p.m. and Mr. Mihalkanin seconded the motion, which passed <br />unanimously. <br /> <br />Mr. Mihalkanin moved the Council reconvene at 8:08 p.m. and Mr. Thomaides <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced one appointment to the Zoning Board of <br />Adjustments and Appeals. Mr. Mihalkanin moved to appoint Ken Moss to the <br />second alternate position and Mr. Taylor moved to appoint Randy Haverda to <br />the second alternate position. On roll call the following vote was <br />recorded: <br /> <br />Moss: <br /> <br />Narvaiz, Thomaides, Mihalkanin and Habingreither. <br /> <br />Haverda: Taylor and Diaz. <br /> <br />Mayor Habingreither introduced three appointments to the Charter Review <br />Commission. Mr. Mihalkanin moved to appoint Sue Cohen, Mayor <br />Habingreither moved to appoint Randy Haverda and Mr. Diaz moved to appoint <br />Ted Hindson on Mr. Montoya's behalf, which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 86, UTILITIES, OF THE CITY CODE TO REVISE LOCAL <br />INDUSTRIAL WASTEWATER DISCHARGE LIMITS, PROVIDE FOR ADMINISTRATIVE <br />REMEDIES, UPDATE DEFINITIONS AND ABBREVIATIONS AND MAKE OTHER <br />ADMINISTRATIVE CHANGES; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />Mr. Mihalkanin moved for approval of the Ordinance on first reading and <br />Ms. Narvaiz seconded the motion. Tom Taggart, Director of <br />Water/Wastewater, stated this Ordinance includes the permit requirements. <br /> <br /> <br />
