<br /> 6~L <br /> CITY in a timely manner. - <br /> 2.1.5 Give prompt written notice to the ENGINEER whenever CITY observes or becomes <br /> aware of any development that affects the scope or timing of the ENGINEER's services or <br /> of any defect in the work of the ENGINEER or construction contractors. <br /> 2.1.6 Include in all construction contracts provisions providing contractor in~emnification <br /> of the CITY and the ENGINEER for the contractor's negligence. <br /> 2.1.7 Publish a public notice documenting the availability of the Draft EA in a newspaper <br /> of general circulation in the area served by the Project. The notice will identify the location <br /> of the Draft EA (i.e., library or City Hall) and that the Draft EA will be available for public <br /> viewing for 30 days. Clippings of the Public Notice for the newspapers and the publisher's <br /> affidavit will be provided to the ENGINEER by the CITY to be included in the Final EA. The <br /> ENGINEER will be provided copies of all of phone memos and written comments received <br /> by the CITY or their consultants. <br /> 2.1.8 Make or arrange to have made subsurface investigations recommended by <br /> ENGINEER, including but not limited to borings, test pits, soil resistivity surveys, and other <br /> subsurface explorations. The CITY shall also make or arrange to have made the <br /> interpretations of data and reports resulting from such investigations. All costs associated <br /> with such investigations shall be paid by the CITY. . <br /> 2.1.9 Conduct the fire hydrant flow tests described in subsection 1.2.42. <br /> 2.2 CITY'S INSURANCE <br /> 2.2.1 The CITY may maintain property insurance on all pre-existing physical facilities <br /> associated in any way with the Project. <br /> 2.2.2 The CITY will have the construction contractor(s) for the Project provide a Builders <br /> Risk All Risk insurance policy for the value of all work on the Project, including the value <br /> of onsite equipment and/or materials associated with the ENGINEER's services. <br /> 2.3 CHANGES <br /> The CITY may make or approve changes within the Basic Services in this Agr~ement. If <br /> the changes affect the ENGINEER's cost of or time required for performance of the <br /> services, an equitable adjustment will be made through an amendment to this Agreement. <br /> ARTICLE 3 <br /> REIMBURSABLE EXPENSES <br /> 13 <br />
