<br /> II VII <br /> SECTION 4. All projects for Fiscal Yêar 1996-97 described in the Capital <br /> Improvements Program portion of the 1996-1997 Budget are approved at the cost level <br /> indicated, subject to the availability of funding of project costs from the Funding Source(s) <br /> identified for each project. <br /> SECTION 5. The Annual Program of Services for the Hotel Occupancy Tax Fund <br /> in the 1996-1997 Budget is approved as the City's promotional program to attract tourists <br /> and convention registrants to the City through <br /> (a) a contract with the San Marcos Area Chamber of Commerce for tourism <br /> promotional services; <br /> (b) a contract with the San Marcos Hispanic Chamber of Commerce for tourism <br /> promotional services; <br /> (c) the operation of the Main Street Program to encourage tourists and <br /> convention registrants to visit the Downtown Historical District; <br /> (d) the operation of the River Stewardship Program, in conjunction with other <br /> programs of the Parks and Recreation Department and the river recreation <br /> programs of the Lions Clubs of San Marcos, as a pron¿otional program to <br /> attract tourists to the City; and <br /> (e) a contract with Capital Area Rural Transportation Systems for the operation <br /> of a tourism-oriented trolley route connecting the retail shopping areas along <br /> IH-35 with hotels and with the Downtown Historical District. <br /> SECTION 6. If any word, phrase, clause, sentence, or paragraph of this ordinance <br /> is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br /> provisions of this ordinance will continue in force if they can be given effect without the <br /> invalid portion. <br /> SECTION 7. All ordinances and resolutions or parts of ordinances or resolutions <br /> in conflict with this ordinance are repealed. <br /> SECTION 8. The importance of this Ordinance creates an emergency and an <br /> imperative public necessity, and the provisions of the Charter requiring that ordinances be <br /> presented at three separate meetings, and that ordinances do not take effect until ten (10) <br /> days after the date of final passage are suspended, and this Ordinance will take effect <br /> upon publication of notice of its adoption in a newspaper of general circulation in the City, <br /> PASSED, APPROVED AND ADOPTED this 9th day of September ,1996. <br /> ~.~~.~~ <br /> Billy G.
