II VII SECTION 4. All projects for Fiscal Yêar 1996-97 described in the Capital Improvements Program portion of the 1996-1997 Budget are approved at the cost level indicated, subject to the availability of funding of project costs from the Funding Source(s) identified for each project. SECTION 5. The Annual Program of Services for the Hotel Occupancy Tax Fund in the 1996-1997 Budget is approved as the City's promotional program to attract tourists and convention registrants to the City through (a) a contract with the San Marcos Area Chamber of Commerce for tourism promotional services; (b) a contract with the San Marcos Hispanic Chamber of Commerce for tourism promotional services; (c) the operation of the Main Street Program to encourage tourists and convention registrants to visit the Downtown Historical District; (d) the operation of the River Stewardship Program, in conjunction with other programs of the Parks and Recreation Department and the river recreation programs of the Lions Clubs of San Marcos, as a pron¿otional program to attract tourists to the City; and (e) a contract with Capital Area Rural Transportation Systems for the operation of a tourism-oriented trolley route connecting the retail shopping areas along IH-35 with hotels and with the Downtown Historical District. SECTION 6. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 7. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 8. The importance of this Ordinance creates an emergency and an imperative public necessity, and the provisions of the Charter requiring that ordinances be presented at three separate meetings, and that ordinances do not take effect until ten (10) days after the date of final passage are suspended, and this Ordinance will take effect upon publication of notice of its adoption in a newspaper of general circulation in the City, PASSED, APPROVED AND ADOPTED this 9th day of September ,1996. ~.~~.~~ Billy G.
