Mark Taylor August 23, 1996 - Page 2 At the present time, our fIrm has adopted a fee structure ranging from $115.00 to $200.00 per chargeable hour for attorneys' services, depending on the individual involved and his or her level of experience and expertise. My hourly fee is $190.00. Additionally, we utilize briefing clerks or legal assistants to perform those tasks not requiring the time of an attorney. Briefing clerk and legal assistant time is billed at the rate of $30.00 to $75.00 per hour, depending upon experience and level of education. We also charge for overtime wages to secretaries when overtime is required to meet client requirements and courier fees for the hand delivery or retrieval of documents. 'rVe will submit all out-of-pocket expenses incurred for reimbursement with our monthly statement of services. "'rVe endeavor to transmit a statement of services rendered and expenses incurred by the 15th of each month, and anticipate being paid within 30 days of receipt. I will be the account representative and the attorney in charge of this matter. Because we endeavor to use the most qualified and available attorney with the lowest effective billing rate for any particular matter, Richard Franchek may also.be associated with me, depending upon the nature of service involved, and you may also contact him for information or status reports should that become necessary. ML Franchek's hourly fee rate is $115.00. Mr. Franchek is an honors graduate of the University of Texas Law School (1994) and holds both M.S. (Environmental Science, TCU, 1991) and B.S. (Texas A&M, 1981, summa cum laude) degrees. Since joining the firm in June of 1995, Mr. Franchek has worked extensively with me on }-varer and wastewater utility regulatory and permitting matters. The monthly statement will list the attorneys who worked on the project, the hourly billing rate of each, and a detailed description of the services performed, accompanied by the billing for such work. We. recognize that express Council approval is required in the event that our firm's fees exceed $15,000.00. Rick Fisher and I have also agreed to discount our normal tèes in this matter by ten percent (10 %) and this discount will be ret1ected on the monthly statement of services performed. It is the policy of our firm to adjust fees periodically to ret1ect current economic conditions. 'rVe will notify you, in advance and in writing, if the fee structure is to be modified, and advise you that our present rates will not be modified during 1996. If this agreement is acceptable to the City, please secure execution of the enclosed duplicate original hereof and return it to us for our records. We look forward to working with you.
