<br /> 17/P <br /> . -5- <br />SECTION 13, All early votes and other votes to be proces~ed in accordance with <br />early voting procedures pursuant to the Texas Electio~ Code shall be delivered to the <br />Early Voting Ballot Board at City Hall Council Chambers, 630 E. Hopkins Street in the City <br />in accordance with the Election Code, Early votes shall be counted at the central counting <br />station, The Early Voting Ballot Bpard shall perform in accordance with applicable <br />provisions of the Election Code, <br />SECTION 14, That an electronic voting system, as the term is defined in the Texas <br />Election Code, shall be utilized in connection with the election, This system shall be <br />utilized for all early voting as well as for all precinct voting conducted on election day. <br />Ramona Brown is hereby appointed as programmer, and she shall prepare a program <br />for the automatic tabulating equipment. Ample voting equipment shall be provided for <br />early voting and in each of the various precincts on election day, The central counting <br />station is established as the office of the Legal Department, San Marcos City Hall, 630 <br />East Hopkins, <br />SECTION 15. That the City Council of the City shall, by resolution, appoint the Early <br />Voting Ballot Board, a Presiding Judge of the Central Counting Station, a Tabulation <br />Supervisor of the Central Counting Station, and a Central Counting Station Manager, and <br />any and all assistants appointed by the Tabulation Supervisor shall be subject to the <br />approval of the City Council. . <br />SECTION 16. That the election shall be held under, and in accordance with the <br />provisions of, the Charter and Ordinances of the City of San Marcos, and in accordance <br />with the laws of the State of Texas, <br />SECTION 17, That a copy of this Ordinance signed by the Mayor of the City, <br />attested by the City Secretary and approved by the City Attorney, shall serve as proper <br />notice of the election. <br />SECTION 18, That notice of the election including a Spanish translation thereof, <br />shall be published at least once in a newspaper published in San Marcos on or after April <br />6, 1995 and on or before April 26, 1995, and shall be posted on the bulletin board at City <br />Hall on or before April 17, 1995'. <br />SECTION 19, That a copy of this Ordinance shall be delivered on or before March <br />27, 1995 to the presiding judge of each election precinct in which the, election is <br />ordered to be held, which copy shall serve as a notice or writ of election as required by <br />the Texas Election Code. <br />SECTION 20. That testing of the automatic tabulating equipment shall be <br />performed and notice thereof shall be given in accordance with Subchapter D of Chapter <br />127 of the Texas Election Code. <br />SECTION 21, That the rate of compensation to be paid judges, clerks, and <br />assistants to the Tabulation Supervisor for services rendered during the joint general and <br />special election by the City and the San Marcos Consolidated Independent School District <br />to be held on May 6, 1995 is hereby established at Six Dollars ($6,00) per hour. <br />SECTION 22, That the additional compensation to be paid judges who deliver <br />returns of the election is hereby established at Twenty-Five Dollars ($25,00). <br />SECTION 23. That if any portion of this Ordinance is held invalid by a court of <br />competent jurisdiction, the remaining provisions of this Ordinance shall remain in full force <br />and effect. <br />SECTION 24, That the importance of this Ordinance creates an emergency and <br />an imperative public necessity so that the provisions of the charter requiring that <br />ordinances shall be presented at three separate meetings and that no ordinance shall <br />become effe~ive until the expiration of ten (10) days following the date of its final passage <br />
