<br /> 17?M <br /> -14- <br /> (5) Private recreational facilities, such as pool halls and <br /> amusement machine rooms; <br /> (6) Restaurants; <br /> (7) Bars, the major business of which is not on-premises sales and <br /> consumption of alcoholic beverages; and, <br /> (8) Guest rooms in hotels and motels, <br /> (b) Common Areas means an area such as a hallway, employee lounge <br /> or lunchroom, or restroom to which more than one employee has <br /> common access; it includes work or office areas shared by 2 or more / <br /> employees. <br /> (c) Employee means any person who is employed by an employer in <br /> consideration for monetary compensation or profit. <br /> (d) Employer means any person, partnership, corporation, association <br /> or other entity, that employs one or more persons. <br /> (e) Place of Employment means any enclosed indoor area under the <br /> control of an employer or to which one or more employees have <br /> access during the course of employment. <br /> (f) Public Area means ar~as such as lobbies, reception areas, retail <br /> merchandise display. areas, restrooms and meeting rooms where <br /> members of the public are commonly present. <br /> (g) Service Line means any indoor line at which one or more persons are <br /> waiting for or receiving service of any kind, whether or not such <br /> service involves the exchange of money. <br /> (h) Smoke, Smokes or Smokin"g includes the carrying or holding of a <br /> lighted pipe, cigar or cigarette of any kind, or any other lighted <br /> smoking equipment or device, and the lighting of, emitting or exhaling <br /> of the smoke ora pipe, cigar or cigarette of any kind. <br /> Sec. 16-61. Offenses. <br /> A person commits an offense if the person: <br /> (1) smokes in a clean air area and is not in an area designated as a smoking <br /> area in accordance with this article; <br /> . (2) is the person in control of a clean air area and permits, or fails to make a <br /> reasonable effort to prevent commission by another of, an offense <br /> described in subsection (1) of this seGtion within such clean air area; <br /> (3) is the person in contrql of a clean air area or a smoking area and fails to <br /> ." place signs in accordance with the requirements òf Sections 16-62 or 16- <br /> 63; <br /> (4)i is the person in control of a clean air area and fails to provide means of <br /> extinguishing smoking items in accordance with the requirements of <br /> "Section 16-63(b); <br /> (5) is an employer who operates a place of employment and fails to adopt, <br />
