N/A;' <br /> 3. N/A' <br /> SECURITY DEPOSIT: $ 600.00 (on deposit) , <br /> PERMITTED USE: Food Program (WIC) <br /> 1. HOLDING OVER. Failure of Tenant to surrender the leased <br /> premises at the expiration of the lease constitutes a holding <br /> over which shall be construed as a tenancy from month to <br /> month at a rental equal to the guaranteed rental plus <br /> additional rental paid during the last month of the Lease <br /> Agreement. <br /> 2. TERMINATION: The Tenant's fiscal year starts on October 1 <br /> and ends on September 30. If there are no funds appropriated <br /> by the Tenant's governing body for this program for any year <br /> that this lease is in effect, the Tenant may terminate this <br /> lease with ten (10) days notice to the Landlord. <br /> 3. RENT. Rent shall be payable in advance without demand, on <br /> the first of each month to 917 West Anderson Lane,' #A, <br /> Austin, TX 78757. Rent received after the first of the month <br /> shall be deemed delinquent. If rent is not received by the <br /> fifth of the month tenant shall be assessed a late charge of <br /> 5% of the rental payment. Late payment charges will accrue <br /> interest at the rate of 18% per annum after 30 days. There <br /> will be a service charge of $35.00 for each returned check. <br /> 4. USE. Tenant shall use the leased premises for the permitted <br /> use listed in the Basic Lease Provisions. Tenant shall not <br /> occupy or allow the leased premises to be occupied for any <br /> business or purpose deemed extra hazardous because of threat <br /> of fire or otherwise. <br /> 5. SECURITY DEPOSIT. Tenant shall pay to Landlord the security <br /> I deposit on or before the commencement of this lease. Refund <br /> I thereof shall be made upon performance of this lease <br /> I agreement in full by Tenant. <br /> 6. INSURANCE. Tenant will pay its proportionate share for fire <br /> and extended coverage insurance on the buildings and other <br /> Common Area improvements. Tenant shall provide public <br /> liability and property damage insurance for its business <br /> operations on the leased premises in the amount of <br /> $1,000,000.00. Said insurance policies required to be <br /> provided by Tenant herein shall name Landlord as an insured <br /> and shall be issued by an insurance company approved by <br /> Landlord.
