¡Q3c- b. Violate or fail to perform any of the covenants performable by Lessee under this Lease after the expiration of thirty (30) days written notice of such violation¡ or c. File a voluntary petition in bankruptcy, be adjudged bankrupt, be placed in or subject to receviership or make an assignment for the benefit of creditors. Upon default, Lessor shall have the right to immediately re-enter and take possession of the Leased Premises, by summary proceedings or otherwise. If the Lessee or his successors or assignS' refuse to surrender the Leased Premises, the Lessor may use such force as may be ~ reasonably necessary to regain possession of the Leased Premises and to remove all persons therefrom. The Lessor shall have the right to institute the statutory action of forcible entry and detainer. Upon re-entering the Leased Premises, the Lessor may remove all or any part of Lessee I s property remaining on the Leased Premises and store the same at Lessee's expense. Upon any default by Lessee, all unpaid rentals, matured and unmatured, shall immediately mature and be due and payable subject to mitigation of such amounts owed through sub-letting the premises and any offsets which are applicable. The pursuit of any one or more of the above remedies shall not deprive Lessor of the right to pursue any other remedies as provided by law. ' 18. NOTICES: All notices required to be given under this Lease or under law, shall be sent to the San Marcos City Manager via certified mail, return receipt requested, and shall be . deemed delivered on the date received by the party receiving the notice as evidenced on the return receipt. BINDING EFFECT: This agreement shall be construed under the laws of the State of Texas and shall be binding upon both parties hereto and their respective heirs, assigns, successors, executors and administrators. 20. VENUE: Venue shall lie in Hays County, Texas for any dispute arising under this Lease Agreement.
