Violate or fail to perform any of the covenants performable by <br /> Lessee under this Lease after the expiration of thirty (30) days <br /> written notice of such violation¡ or <br /> c. File a voluntary petition in bankruptcy, be adjudged bankrupt, <br /> be placed in or subject to receviership or make an assignment for the <br /> benefit of creditors. <br /> Upon default, Lessor shall have the right to immediately re-enter <br /> and take possession of the Leased Premises, by summary proceedings or <br /> otherwise. If the Lessee or his successors or assignS' refuse to <br /> surrender the Leased Premises, the Lessor may use such force as may be <br /> ~ reasonably necessary to regain possession of the Leased Premises and to <br /> remove all persons therefrom. The Lessor shall have the right to <br /> institute the statutory action of forcible entry and detainer. <br /> Upon re-entering the Leased Premises, the Lessor may remove all or <br /> any part of Lessee I s property remaining on the Leased Premises and <br /> store the same at Lessee's expense. <br /> Upon any default by Lessee, all unpaid rentals, matured and <br /> unmatured, shall immediately mature and be due and payable subject to <br /> mitigation of such amounts owed through sub-letting the premises and <br /> any offsets which are applicable. <br /> The pursuit of any one or more of the above remedies shall not <br /> deprive Lessor of the right to pursue any other remedies as provided by <br /> law. ' <br /> 18. NOTICES: All notices required to be given under this Lease or <br /> under law, shall be sent to the San Marcos City Manager via certified <br /> mail, return receipt requested, and shall be . deemed delivered on the <br /> date received by the party receiving the notice as evidenced on the <br /> return receipt. BINDING EFFECT: This agreement shall be construed under the laws <br /> of the State of Texas and shall be binding upon both parties hereto and <br /> their respective heirs, assigns, successors, executors and <br /> administrators. <br /> 20.
