<br /> 19 <br /> RESOLUTION 1995- 42 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, DOCUMENTING THAT THE <br /> FORMER COCA-COLA BOTTLING PLANT LOCATED IN THE <br /> 200 BLOCK OF WEST SAN ANTONIO STREET QUALIFIES <br /> AS SLUM AND BLIGHTED ON A SPOT BASIS UNDER <br /> LOCAL LAW; DESCRIBING THE CONDITIONS OF BLIGHT <br /> THAT ARE TO BE TREATED AND THE CONDITIONS <br /> DETRIMENTAL TO PUBLIC HEALTH AND SAFETY THAT <br />¡ WILL BE CORRECTED; PROVIDING THE SCOPE OF THE <br /> REHABILITATION TO BE FUNDED UNDER THE SMALL <br /> BUSINESS INCUBATOR GRANT CONTRACT WITH THE <br /> TEXAS DEPARTMENT OF HOUSING AND COMMUNITY <br /> AFFAIRS; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The City Council wishes to provide for a stable tax base and prevent the decline <br />of property values within the City. <br />2. The former Coca-Cola bottling plant (the "plant") located in the 200 block of West <br />San Antonio Street has been vacant since 1986, and a fire seriously aamaged the plant's <br />two-story building on April 25, 1994. <br />3. The plant has numerous building and fire code violations which pose serious <br />health and safety hazards. <br />4. Persons seeking temporary shelter in buildings within the plant are endangering <br />themselves. <br />5. The failure to address these health ,and safety hazards will lead to further <br />deterioration of the plant and the surrounding neighborhood. <br />6. The City Council at the request of the Greater San Marcos Economic <br />Development Council, designated the plant as slum or blighted on a spot basis to facilitate <br />a grant application under the Texas Capital Fund Small Business Incubator Program in <br />Resolution 1993-154R. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. That the plant is documented to quality as slum and blighted on a spot <br />basis due to its failure to meet numerous City building, electrical, plumbing and fire code <br />requirements, as described in the building inspector's and fire marshal's reports attached <br />as Exhibit A. <br />PART 2. That the conditions of blight and decay that are to be treated, and the <br />conditions detrimental to public health and safety that are to be corrected, and the details <br />and scope of the rehabilitation funded under the City's small business incubator contract <br />with the Texas Department of Community Affairs, are described on the attached Exhibit B. <br />PART 3.
