<br /> - <br /> ~/ß <br /> -3- <br /> (e) Deposits will be refunded as follows: <br /> (1 ) The excess of a customer's deposit over any unpaid water <br /> and/or sewer bills at the time of termination of service will be <br /> refunded; and <br /> (2) A deposit will be refunded in cash or as a credit to the <br /> customer's account, or returned to the customer if a letter of <br /> credit, if the account has had no late payments during the last <br /> 12 consecutive months, or not more than 1 late payment during <br /> the last 24 consecutive months. <br /> SECTION 3. That Section 30-20 of the San Marcos Code of Ordinances is <br /> amended to read as follows: <br /> Sec. 30-20. Delinquencies: penalty: disconnection. <br /> (a) A bill for city utility services, including water, sewer, solid waste <br /> collection and electricity, which are billed in a consolidated manner is considered <br /> delinquent if the full amount of the bill is not paid by the< due date. A bill is <br /> considered paid when payment is received by the city. <br /> (b) A penalty service charge of 10% will be assessed against the portion <br /> of all delinquent bills for active accounts that is not paid before the penalty date. <br /> For state agencies, a 1 % per month interest charge will be made to any part of <br /> a bill that is not paid within 30 days from the receipt of the bill. An account is <br /> considered inactive if it is delinquent for more than 30 days. <br /> (c) Any or all city utility services r:nay be terminated for nonpayment of all <br /> or any portion of a bill for city utility services if a termination notice is given by the <br /> city, the bill is not contested under the city's procedures, and at least 25 days <br /> have elapsed since the date of issuance of the bill. <br /> SECTION 4. That Section 30-21 of the San Marcos Code of Ordinances is <br /> amended to read as follows: <br /> Sec. 30-21. Miscellaneous service fees. <br /> (a) A new account connection fee set by separate ordinance must be paid <br /> to initiate city water and/or sewer service. An additional fee set by separate <br /> ordinance must be paid for a request for connection services to be provided <br /> outside of normal city operating hours. <br /> (b) A non-payment reconnect fee set by separate ordinance must be paid <br /> to restore services to a customer whose service was terminated for non-payment <br /> of a bill. An additional fee set by separate ordinance must be paid for a request <br /> for reconnection services to be provided outside of normal city operating hours. <br /> (c) A temporary meter rental fee set by separate ordinance must be paid <br /> for the use of any temporary meter, in addition to the new account connection <br /> fee. <br /> (d) A tampering fee set by separate ordinance must be paid each time as <br /> a customer causes or permits any tampering with city metering equipment, or <br /> any attempt to divert utility service around metering equipment. This fee will be <br /> in addition to the cost of repairs and replacement of equipment, and estimated <br /> charges for any diverted services. <br /> (e) A meter test fee set by separate ordinance must be paid when a <br />
