<br /> 5. A condition which states that the Sponsor certifies that all taxes are current and Mure <br /> \axes 'ffi\\ 00 paid 'Hhet'\ due; <br /> 6. A condition which restricts the Sponsor from sub-leasing the facilities described in <br /> Special Condition H except Building Five, brick single family dwelling, to non-incubator tenants <br /> without the approval of Contractor during the contract period; <br /> 7. A condition requiring Contractor to make quarterly on-site visits to the real estate as <br /> more fully described in Special Condition H to assess/monitor the progress toward the <br /> establishment and operation of the small business incubator and requiring the Sponsor to <br /> provide to local officials at the time of on-site visits information regarding the establishment and <br /> operation of the small business incubator and any other information deemed necessary by <br /> Contractor to administer this contract; <br /> 8. Provisions requiring records to be kept and reports to be made regarding the documen- <br /> tation of the establishment and operation of the small business incubator in the same manner <br /> and to the same extent as Department requires of Contractor; <br /> 9. A condition which allows Contractor to release the Sponsor from its obligations <br /> under this contract upon approval of Department; and <br /> 10. Any other relevant details or special conditions placed on the contract. <br /> D. Contractor shall not advertise or solicit bids for construction or rehabilitation of a project assist- <br /> ed with funds provided under this contract until Contractor has received the applicable prevailing <br /> wage rates from Department. <br /> ~ <br /> E. Contractor shalt submit to Department documentation of San Marcos Industrial Foundation's <br /> executed loan agreement of Twenty-five Thousand and No/1oo Dollars ($25,000) from State Bank <br /> and Trust to be utilized in conjunction with the project funded under this contract prior to <br /> Department's release of project funds for construction/rehabilitation. <br /> F. Contractor shall provide Department with a vermcation of deposit which reflects that San Marcos <br /> Industrial Foundation has Eighty-six Thousand and No/100 Dollars ($86,000) in cash available to <br /> inject into this project prior to Department's release of contract funds. <br /> G. Contractor shall provide Department documentation of San Marcos Industrial Foundation's equity <br /> injection of Eighty-six Thousand and No/100 Dollars ($86,000) prior to Department's release of <br /> construction/reharntitation funds. This injection shall be in the form of cash equity. <br /> H. Contractor shall submit to Department a copy of the recorded deed, pertaining to the real estate <br /> identified in this Special Condition H, prior to Department's reJease of construction/rehabilitation <br /> funds for such project. The legal description for the project site follows: <br /> That certain 59,377 plus or minus square feet of land better known as Lots 6, <br /> 7, 8, 9 and one-half of Lot 1 0, Block 16 of the Original Township of San <br /> Marcos, Hays County, Texas. <br /> This real estate ¡ndudes five facilities described as follows: (1) Building One, 360 square foot <br /> masonry office with walk-in safe; (2) Building Two, brick office/warehouse with 15,442 square foot <br /> warehouse and approximately 2,556 square feet of office; (3) Building Three, 360 square foot metal <br /> Page 12 of 16 <br />
