<br /> 53 <br /> RESOLUTION 1995 - 54 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS APPROVING A DEED <br /> CORRECTING THE DEED CONVEYING A TRACT OF <br /> PROPERTY IN BLOCK 12 OF D.S. COMBS ADDITION TO <br /> TUTTLE LUMBER COMPANY; AUTHORIZING <br /> REIMBURSEMENT OF $1,776.59 TO TUTTLE LUMBER <br /> COMPANY; AUTHORIZING THE CITY MANAGER TO <br /> EXECUTE THE CORRECTION DEED; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> RECITALS: <br /> 1. On November 28, 1994, the City Council approved the sale of a <br /> 0.432 acre tract of property in Block 12 of the D. S. Combs <br /> Addition, San Marcos, Texas to Tuttle Lumber Company. <br /> ," " <br /> 2. A surveying error was revealed after the above sale in that <br /> the subject tract should have been 0.330 acre. <br /> 3. The amount of $1,776.59 is the apportionate percentage of <br /> Tuttle Lumber Company's bid which should be reimbursed. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the City Manager, Larry D. Gilley, is <br /> authorized to execute a correction special warranty deed conveying <br /> to Tuttle Lumber Company the 0.330 acre property described above. <br /> PART 2. That the sum of $1,776.59 to be reimbursed to Tuttle <br /> Lumber Company is approved. <br /> PART 3.
