<br />- <br /> <br />T 56 <br /> <br /> <br /> <br /> <br />PUBLIC TRANSIT SYSTEM AGREEMENT <br /> <br />STATE 0 F TEXAS <br />~" COUNTY OF HAYS <br />I <br />I <br />I <br /> <br /> <br />1. Parties <br /> <br />This agreement is between the Capital Area Rural Transportation System, an agency <br />created by agreement of nine central Texas counties under the Texas Interlocal <br />Cooperation Ac~,. P. O. Box 6050, Austin, TX 78702 ("CARTS"), and the City of San <br />Marcos, Texas, a Texas municipal corporation, 630 East Hopkins Street, San Marcos, TX <br />78666 (the "City"). <br /> <br />2. Term <br /> <br />The term of this agreement will begin April 1, 1995 and will end September 30, 1996. The <br />continuation of this agreement in future fiscal years of the City is subject, however, to the <br />appropriation of funds in the City's budget for those fiscal years by the City's governing <br />body. CARTS' performance under this agreement will be contingent upon its continued <br />receipt of state and federal funding to operate the System. <br /> <br />3. Transit System Services <br /> <br />CARTS agrees to establish, operate and maintain a public transit system (the "System") <br />within the City in accordance with this agreement. <br /> <br />4. Payments by City <br /> <br />The City will pay CARTS $70,000 per year towards the cost of operating the System. The <br />cost of operating the System includes Operating Expenses and Project Administrative <br />Expenses as those terms are described in FTA Circular 9040. 1 dated November 3, 1992. <br />These payments will be made on a monthly basis upon submission of an invoice by CARTS <br />to the City. CARTS will be solely responsible for all capital costs related to tt¡e System. <br /> <br />5. Routes and Schedules <br /> <br />The System will use the fixed routes described on Attachment 1, and the fixed route <br />schedule described on Attachment 2. CARTS may change these routes and schedule with <br />
