During the period from April 1, 1995 <br />through September 30, 1995, CARTS will operate an interim start-up service (the "Interim <br />Service") that will use these same routes, but the schedule will provide for two-hour <br />intervals between vehicles passing the same stop rather than one-hour intervals. <br /> <br />--- 6. Fares <br />¡ <br />; <br /> <br />i The fares charged by CARTS will not exceed the maximum rates approved by the City <br />Council of the City. The City Council will conduct a public hearing before approving any <br />maximum rates. <br /> <br />7. Vehicles <br /> <br />By not later than 'October 1, 1995, CARTS will use the following vehicles in operating the <br />System: <br /> <br />a. Two trolleys having a capacity of at least 28 passengers, and substantially <br />equivalent in design and appearance to the trolley described on Attachment <br />3; and <br />.¡ <br />b. Three buses having a capacity of at least 28 passengers, and substantially <br />equivalent in design and appearance to the bus described on Attachment 4. <br /> <br />All of these vehicles will be new as of their initial use in the System. CARTS may use other <br />vehicles in operating the System only in a temporary back-up capacity. <br /> <br />CARTS will use two buses similar to those described on Attachment 4 to operate the <br />Interim Service. <br /> <br />8. Shelters and Transfer Station <br /> <br />CARTS will provide and maintain shelter facilities to serve the System. CARTS will obtain <br />the written approval of the City Manager of the City for the number of shelters to be used, <br />the design of the shelters, the locations for their placement, and any signage placed on the <br />shelters. CARTS may change, add and delete shelter locations with the written approval <br />of the City Manager. <br /> <br />CARTS will establish and maintain a transfer facility for the System in the downtown area <br />of San Marcos. The design, layout and location of the transfer facility is subject to the <br />written approval of the City Manager of the City. <br /> <br />9. Independent Contractor <br /> <br />CARTS is an independent contractor under this agreement, and not an agent or partner of <br />
