<br />. <br /> <br />ý'fo6 <br /> <br />-3- <br />the City. CARTS is solely responsible for the administration of the System. <br /> <br /> <br /> <br />10. Performance Reports <br /> <br />-- On or before January 31 of each year of this agreement, CARTS will submit a performance <br />report covering CARTS' operation of the System during the preceding calendar year. The <br />report will include at least the following information for the System and for each route: <br /> <br />a. Efficiency: <br /> <br />1. Cost per trip <br /> <br />2. Co"st per revenue hour of operation <br /> <br />3. Cost per revenue mile of operation <br /> <br />b. Effectiveness: <br /> <br />1. Passengers per revenue mile . <br /> <br />2. Passengers per revenue hour <br /> <br />3. The percentage of the public transit demands identified in CARTS' January <br />23, 1995 report to the City Council of the City that are being served by the <br />System. <br /> <br />11. Audit. <br /> <br />CARTS agrees to maintain accounts and records'for all costs of operation of the System, <br />and CARTS agrees to provide the City with an annual audit of such accounts and records <br />prepared by a certified public accountant. <br /> <br />12. Waiver of Franchise Fees <br /> <br />The City, as part of its consideration for this agreement, waives any franchise fees it is <br />authorized to impose upon CARTS for the operation of the System upon the public streets <br />of the City. <br /> <br />13. Insurance <br /> <br />CARTS agrees to maintain in full force and effect all forms of insurance required by local, <br />state and federal regulatory authorities in at least the minimum amounts prescribed by <br />those authorities. CARTS will furnish written certificates of such coverage to the City <br />
