87 LEASE OF AIRPORT PROPERTY AND HANGAR THE STATE OF TEXAS COUNTY OF CALDWELL This Lease Agreement (this "Lease") is made by the City of San Marcos ("Lessor") and Southwest Texas Aviation, Inc. ("Lessee"). The City of San Marcos, Texas, is the owner of the San Marcos Municipal Airport, situated in Caldwell County, Texas, ("Airport") by virtue of indentures from the United States of America dated the 24th day of February, 1966, and the 14th day of July, 1969, and the 11th day of May, 1976, and the 19th day of December, 1990. Lessee, a sub-chapter "S" corporation with Russell Stallings as its president, is currently leasing other property, from the Lessor under an assignment of a lease agreement entered into on January 27, 1981. In consideration of the obligation of Lessee to pay the rent set by this Lease and in consideration of the other terms Lessor demises and leases to Lessee, and Lessee takes from Lessor the following: The real property at the San Marcos Municipal Airport in Caldwell County, Texas, together with all current and future improvements, as described in Exhibit "A" and incorporated fully within this Lease for all purposes. Such premises are called the "Leased Premises" and consist of land, a concrete slab and a hangar. The term of this Lease is from February 22, 1994 and to February 2l, 2014, under the following terms and conditions: ARTICLE 1. Lessee's Comp1iance with Airport Regu1ations 1.01 Lessee acknowledges that it will comply with the San Marcos Municipal Airport Standard Operation Procedures and Regulations ! and the Minimum Standards for Fixed Base Operators and Airport Tenants, as these now exist or may be amended during the term of this Lease, and any conflict between this Lease and these procedures, regulation and standards will be resolved in favor of said procedures, regulations and standards. ~-
