<br /> 17/1 <br /> ARTICLE 2. <br /> Lessee' s Payment to Lessor <br /> 2.01 Land Rental for the Leased Premises: Lessee will pay Lessor <br /> <br /> ten cents ($.10) per square foot of the Leased Premises per <br /> year. Payments are to be made upon commencement of this Lease <br /> and on each anniversary of the commencement of this Lease. <br /> ~- <br /> Rental fees due under this portion of the Lease will be reviewed <br /> by Lessor every five (5) years in relation to the consumer price <br /> index and escalated accordingly. The rental will never decrease <br /> from the original amount. <br /> " <br /> 2.02 Rental for the Hangar to be built on the Leased Premises: After <br /> <br /> the commencement date of this Lease, if Lessor receives grant <br /> funds from the Texas Department of Commerce/Texas Department of <br /> Housing and Community Affairs Real Estate Dev~lopment Program, <br /> Texas Capital Fund ("TCF") in at least the amount of the total <br /> of the lowest responsible bid on the project and the required <br /> engineering or architect's fees, Lessor will construct a metal <br /> hangar (the "Hangar") on the Leased Premises. Lessee will pay <br /> $402.73 per month to the Lessor for rental of the Hangar. Total <br /> rental for the Hangar for the lease term is $89,155.00. This <br /> Hangar along with all fixtures will at all times belong to the <br /> Lessor, unless Lessee exercises the Lease Purchase Option <br /> provided for in Article 7. In the event that the total of the <br /> lowest responsible bid and the engineering or architect's fees <br /> exceeds the total of grant funds available for these purposes <br /> from TCF, this Lease may be terminated by the Lessor or the <br /> Lessee with ten (10) days notice. <br /> 2.03 Rental fees described in Sections 2.01 and 2.02 are due on the <br /> first day that the Hangar is completed and accepted by Lessee. <br /> This date will be the commencement date of this Lease. <br /> Subsequent payments shall be due and payable on or before the <br /> tenth (10th) day of the month.
