<br /> ?J7ß <br /> payable by Lessee under this Lease shall be prorated <br /> accordingly. <br /> 2.04 Lessee must pay Lessor an annual fee equal to one percent (1%) <br /> of the gross revenues of all of Lessee's commercial operations <br /> at or using the facilities of the San Marcos Municipal Airport, <br /> excluding aircraft sales and any sales or services to federal! <br /> - <br /> state or local governments or other tax exempt organizations or <br /> agencies. Lessee will provide Lessor access to any business <br /> records reasonably necessary to verify the amount of the annual <br /> fee. This percentage of gross revenues is not in addition to <br /> any such percentage owed under any other current lease agreement <br /> with the Lessor. <br /> 2.05 Lessee's use of the airpòrt ramp area for any uninterrupted <br /> period of 72 hours or longer will be subjec.t to payment by <br /> Lessee of the tie-down fee or public use fees established by <br /> Lessor! if any. The term "airport ramp. area" includes any area <br /> of the San Marcos Municipal Airport not leased by Lessee. <br /> 2.06 All airport revenue derived from Lessee and any other user of <br /> the Leased Premises, excluding hangar rental which is program <br /> income from TCF, must be allocated toward the maintenance and <br /> improvement of the Airport. This requirement shall not be <br /> considered mandatory upon Lessor unless it is required by <br /> existing indenture or agreement with the Federal Government or <br /> any amended or substitute indentures and agreements entered into <br /> with the Federal Government. <br /> ARTICLE 3. <br /> Grant Compliance TeDllS <br /> 3.01 Lessee acknowledges that the Hangar is to be constructed with <br /> grant funds provided by the State of Texas under a contract <br /> ("the Grant Contract") between the Texas Department of Housing <br /> and Community Affairs (IITDHCA") and the Lessor. A copy of the <br /> Grant Contract is attached hereto as Exhibit "B" and <br /> . -- <br /> incorporated herein as if copied in its entirety. Lessee also <br /> acknowledges that the Lessee's obligations in this Article are <br /> conditions for the receipt of the grant funds for the Hangar, <br /> -3- <br />
