<br /> ?l7S <br /> there shall be excluded from the computation of any such period <br /> of time, any delays due to strikes riots, acts of God, shortages <br /> of labor or materials, war, goverrunental laws, regulations or <br /> restrictions or any other causes of any kind whatsoever which <br /> are beyond the reasonable control of Lessor. <br /> 16.08 Lessor represents and warrants that Lessor has full right and <br /> ~ <br /> lawful authority to enter into and perform the Lessor's <br /> obligations under this Lease for the full term as stated above, <br /> and all extensions here provided, and has title to the Leased <br /> Premises as shown by the Indenture between the United States <br /> Government and Lessor which has been incorporated by reference. <br /> Lessor further covenants that upon payment of the rent, Lessee <br /> shall have and enjoy, during the term, quiet and undisturbed <br /> possession of the Leased Premises, together w.:!-th the right to <br /> use the runways and taxiways of the airport facility. However, <br /> this Lease is subject to the right of the United States of <br /> America to have exclusive or non-exclusive use, control and <br /> possession without charge, of the airport or any portion during <br /> periods of National Emergency and to the right of the Federal <br /> Aviation Administration and United States Goverrunent to take a <br /> portion of the airport premises for air traffic control <br /> activities, weather reporting activities, or communication <br /> activities related to air traffic control, all as provided in <br /> the Indenture. <br /> 16.09 Nothing in this Lease shall be construed by the parties, nor by <br /> any third party, as creating the relationship of principal and <br /> agent or of partnership or of joint venture between the parties, <br /> it being understood that neither the method of computation of <br /> rent, nor any other provision, nor any acts of the parties, <br /> shall be deemed to create any relationship between the parties <br /> other than the relationship of Lessor and Lessee. <br /> 16.10 Lessee warrants that it has no dealings with any broker or agent <br /> . <br /> in connection with the negotiation or execution of this Lease <br /> and Lessee will indemnify and hold Lessor harmless from and <br /> against any and all costs, expense or liability for commissions <br /> -20- <br />
