<br /> : .: <br /> 50 <br /> REAL PROPERTY ACQUISITION <br /> AND WATER RIGHTS NEGOTIATION <br /> I NTERL 0 CAL AGREEMENT <br /> State of Texas <br /> County of Travis <br /> The City of San Marcos, a Texas municipal corporation, ("San <br /> ,-- Marcos") and the city of Austin, a Texas municipal corporation, <br /> ! ("þ..ustin") enter into this Interlocal Agreement ("Agreement") under <br /> the Authority of the Interlocal Cooperation Act, Chapter 791 of the <br /> Texas Government Code, as amended, in connection with a surface <br /> water treatment plant site acquisition and possible acquisition of <br /> San Marcos River water rights by San Marcos. <br /> 1. Austin's Services. The Services to be provided by this <br /> Agreemertt' "viII occur in two Phases, with Phase I being the <br /> acquisition of a surface water treatment plant and off-channel <br /> storage reservoir site acquisition,and transmission pipeline <br /> easement acquisition, and Phase II being the possible <br /> acquisition of water rights. Services under Phase I of the <br /> Agreement are needed immediately and shall begin on the <br /> effective date of the Agreement. Phase II of the Agreement <br /> shall not begin until a revised Agreement is r~ached between <br /> the parties .which more specifically identifies the scope of <br /> services t? be' performed. Services under Phase I to be <br /> provided by Austin to San Marcos under this Agreement are as <br /> follo"vs: <br /> A. APPRAISALS, ENVIRONMENTAL ASSESSMENTS AND LAND PLANS <br /> Under Phase I, Austin "viII: <br /> ! (1) Assist San Marcos in .the selection and hiring of <br /> appraisal, environmental and land planning <br /> consultants as necessary and coordinate with <br /> consultants to ensure compliance with all land <br /> acquisition and eminent domain requirements in <br /> preparation of documents such as appraisals, <br /> environmental assessments and land plans. <br /> (2) Obtain right of entry for surveying, geotechnical, <br /> environmental, land plan and appraisal purposes. <br /> ( 3) Assist with the preparation of field notes. <br /> (4) Ensure that all documents received by San Marcos <br /> are complete.
