ACQUISITION OF PROPERTY AND WATER RIGHTS <br /> Under Phase I, Austin will: <br /> (1) Provide and supervise all property acquisition <br /> services to ensure compliance with all lar.vs and <br /> regulations applicable to these services. <br /> (2) Provide appropriate valuation and negotiation <br /> services to acquire rights specified by San <br /> Harcos's engineering consultant. <br /> (3) conduct negotiations with all property owners <br /> ~ . utilizing personal contact where practical. <br /> (4-) Conduct negotiations for purchase contracts. <br /> ( 5) Provide all required notices and negotiation <br /> correspondence. <br /> (6) Haintain complete and accurate negoti~tion logs. <br /> (7) Review all counter offers from property owners if <br /> applicable, and make recommendations concerning <br /> settlements to San Harcos for its approval. <br /> ( 8) Assist San Marcos in formulating final offers. <br /> (9) Assist San Harcos in reviewing and editing purchase <br /> contracts and make recommendations to San Marcos <br /> regarding its acceptance of those contracts. <br /> (10) Provide coordination and testimony for eminent <br /> domain proceedings as may be necessary to complete <br /> acquisition of parcels not acquired through the <br /> negotiation process. <br /> (11) Haintain complete eminent domain packages for San <br /> Marcos's use in possible eminent domain <br /> proceedings.
